No person shall construct or maintain any driveway across any sidewalk or curbing, or connect his property to any public right-of-way with a driveway, without first obtaining a driveway permit from the Village Board. Permittee shall submit a detailed plan to the Building Inspector that accurately describes the following:

Location of driveway.
B. 
Slope of the driveway.
C. 
Erosion control features while under construction.
D. 
Realistic construction schedule for driveway completion.
E. 
Compliance with construction standards and policies contained in this chapter.
A. 
Width. Residential driveways shall not be less than 12 feet nor more than 24 feet in width at the street edge of the sidewalk unless approved by the Building Inspector. Commercial driveways shall not be less than 18 feet nor more than 35 feet in width at the street edge of the sidewalk unless approved by the Building Inspector. No driveway shall flare more than four feet from the edge of the sidewalk to the curb, unless approved by the Building Inspector.
B. 
Interference with intersections prohibited. At street intersections, a driveway shall not provide direct ingress or egress to or from the street intersection area. The driveway shall not occupy areas of the roadway deemed necessary by the Village Board for effective traffic control or for highway signs or signals. All entrances and approaches shall be at least 30 feet from the corner at the closest point of entrance.
C. 
Interference with street. No driveway apron shall extend out into the street further than the face of the curb, and under no circumstances shall such driveway apron extend into the gutter area. All driveway entrances and approaches shall be so constructed that they shall not interfere with the drainage of streets, side ditches or roadside areas or with any existing structure on the right-of-way. When required by the Director of Public Works to provide for adequate surface water drainage along the street, the property owner shall provide any necessary culvert pipe at his own expense.
D. 
Number of approaches limited. No more than one driveway entrance and approach shall be constructed for any lot or premises except by approval of the Village Board. Any two approaches shall be at least 10 feet apart.
E. 
Workmanship and materials. All driveway entrances and approaches which are constructed across sidewalks shall be paved in accordance with the requirements for sidewalk construction in § 321-6 of the Village Code insofar as such requirements are applicable, including thickness requirements in § 321-6D.
F. 
Slope. No driveway shall have a slope greater than one foot vertical rise in every 10 feet of horizontal run. If the building plan or topography requires a steeper grade, the Building Inspector must review the construction plan before a permit will be granted. Transition slopes between driveways and sidewalks must conform to the regulations of the Americans with Disabilities Act (ADA).
G. 
Erosion control. All excavation, construction and landscaping related to the driveway construction shall be in accordance with Chapter 170, Erosion Sediment and Water Runoff Control.
H. 
Curb and gutter replacement. To the extent that curb and gutter installation or replacement is necessary, all work shall be at the property owner's expense. Construction procedures and schedules shall follow those standards described in the Driveway Entrance Construction Policy as approved by resolution of the Village Board.
I. 
Materials required. All new driveways for new construction will be paved with bituminous materials or concrete prior to issuance of the occupancy permit. Failure of the property owner to follow guidelines may result in Village action to install the driveway at the owner's expense.
J. 
Permittee liable for damage or injury. The permittee shall assume all responsibility for any injury or damage to persons or property resulting directly or indirectly during construction or repair of driveway approaches or entrances. When curb or gutter is removed, the new connection shall be of equivalent acceptable material and curb returns provided or restored in a neat, workmanlike manner. Driveway surfaces shall connect with the street pavement and sidewalk in a neat, workmanlike manner. Any sidewalk areas which are damaged or are inadequate by reason of vehicle travel across the sidewalk shall be replaced in accordance with the requirements of § 321-6 of the Village Code.
The penalty for violation of any provision of this section shall be a penalty as provided in § 1-3 of the Village Code.
The fee for a driveway construction permit on existing structures shall be determined by resolution of the Village Board and posted in the office of the Village Clerk/Treasurer. For new construction, the fee shall be included in the total building permit fee and the driveway construction plans shall be submitted with the building plans. Payment shall be made to the Village Clerk/Treasurer prior to construction.
