No permit to demolish any building or structure or any part thereof shall issue except in accordance with this article; provided, however, that this article shall not apply to buildings or structures which are shown by the applicant to the satisfaction of the Building Official to have been constructed less than 100 years prior to the filing of the application, or which are shown to have a ground level area of less than 300 square feet.

Within 10 days of the filing of an application for a demolition permit, the Building Official shall cause a notice to be published in a newspaper having a substantial circulation in the municipality, which notice shall state that an application for a demolition permit has been filed; the date on which the application was filed; the address of the property upon which the building or structure to be demolished is located; the identification of the building or structure to be demolished; and the name and address of the owner of the property. The notice shall further state that, unless specific written objection to the proposed demolition is filed with the Building Official within 30 days of the publication of the notice, the permit may be issued at that time. Within 10 days of the filing of the application, the Building Official shall also send a copy of the notice by first-class mail to each person, firm, corporation, organization or entity registered in accordance with § 196-6 of this article and shall provide the applicant with a copy of the notice.
The Building Inspector shall maintain a registry of all persons, firms, corporations, organizations, and other entities which state, in writing, their desire to be notified of applications for demolition permits.
The applicant shall, within 10 days of the filing of the application, send copies of the notice provided by the Building Inspector to the owners of all properties within 150 feet of the boundary of the property on which the building or structures to be demolished is located as shown on the last completed grand list and shall provide proof of his compliance herewith to the Building Official within 30 days of the publication of the notice by the Building Official.
If no objection to the application is received by the Building Official by the 30th day following the publication of the notice, the Building Official may issue the permit forthwith; provided, however, all of the requirements of C.G.S. § 29-406 have been met. If one or more objections to the issuance of the permit have been received by the Building Official by the 30th day following the publication of the notice, the Building Official shall not issue any permit until the 90th day following the filing of the application therefor.
At the time the application is filed, in addition to such filing fees as may otherwise be required, the applicant shall pay to the Building Official $75 to defray the cost of publication and mailing of the notice.
The provision of this article are in addition to, and not in limitation of, the powers, duties and authority of the Building Official otherwise prescribed by law or regulation. Nothing in this article, however, shall limit the authority of the Building Official or other lawful authority to order the immediate demolition of any building or structure, or any part thereof, when public health or safety requires.
