Pools used for swimming or bathing by human beings shall be
in conformity with the requirements of this article; provided, however,
these regulations shall not be applicable to any such pool less than
24 inches deep, except when such pool is permanently equipped with
a water recirculating system.
For the purpose of this article, the terms used herein are defined
as follows:
Any pool which is used or intended to be used by the family
of the householder and his private guests and which is erected without
requiring a foundation on the ground and with materials easily joined,
coupled or assembled and capable of being dismantled and returned
to their original condition.
Any pool which is used or intended to be used by the family
of the householder and his private guests and which is not a private,
portable swimming pool.
Any swimming pool other than a private, portable swimming
pool or a private, permanent swimming pool.
All swimming pools shall not encroach on any front or side yard
required by the Basic Building Code of the State of Connecticut, Abridged
Basic Building Code of the State of Connecticut, the Building Code
and building and zoning regulations of the City of Norwalk.[1] No wall of any such swimming pool shall be located less
than six feet from any rear or side property line nor 10 feet from
any street property line except as otherwise may be provided by the
City of Norwalk.
A.
Permanent, private, semipublic or public pools used for swimming
or bathing, and their equipment or accessories, which are constructed,
installed and maintained in accordance with the applicable standards
listed in Appendix B of the Basic Building Code of the State of Connecticut
shall be deemed to conform to the requirements of said Basic Code,
provided the requirements of Section 429.8 of said Basic Code are
included in the installation.
B.
A private, portable swimming pool need not conform with Section 429.8
of the Basic Building Code of the State of Connecticut, but a natural
barrier, hedge, pool cover or other protective device shall be used
as a safety precaution.
A.
No swimming pool or appurtenances thereto, except a private, portable
swimming pool, shall be constructed, installed, enlarged or altered
until a permit has been obtained from the Building Inspector of the
City of Norwalk. The approval of all governmental authorities having
jurisdiction over permanent swimming pools shall be obtained before
applying to the Norwalk Building Inspector for a permit. Certified
copies of these approvals shall be filed as part of the supporting
data for the application for the permit.
B.
Plans shall accurately show dimensions and construction of pool and
appurtenances and properly established distances to lot lines, buildings,
walks and fences; details of water supply system, drainage and water
disposal systems, and all appurtenances pertaining to the swimming
pool. Detail plans of the structures, vertical elevations, sections
through the pool showing depth shall be included.
Swimming pool design, construction, water treatment, drainage,
electrical appurtenances and other safety considerations not specifically
set forth herein shall comply with all state, federal and local codes
and regulations except as otherwise stated herein.
This ordinance shall take effect after due compliance with the provisions of § 1-193 of the Charter of the City of Norwalk.
