GENERAL REFERENCES

A. 
The City of Washington hereby creates the position of Delinquent Tax Collector for the City of Washington.
B. 
Said position shall be created as a management position, with its Fair Labor Standards Act ("FLSA") status to be "exempt" with regard to overtime pay and with the individual holding said position to be given broad powers as set forth in the job description with regard to supervisory powers as well as utilizing the discretion of the Collector to resolve delinquent tax claims subject to the restrictions imposed by applicable statutes.
A. 
The Mayor and Council of the City of Washington shall periodically evaluate the performance of the Delinquent Tax Collector and determine whether it is most appropriate to continue with an inhouse delinquent tax collector or whether it would be more appropriate to utilize the services of an outside agency or other delinquent tax collection process. The Mayor and Council shall continue to utilize the services of such inhouse Delinquent Tax Collector as determined appropriate by the Mayor and Council of the City of Washington.
B. 
In the event that the Mayor and Council of the City of Washington should determine that utilizing an inhouse delinquent tax collector is no longer in the best interest of the City, the Mayor and Council may terminate said position at the sole discretion of the Mayor and Council.
C. 
In the event that the Mayor and Council would take such action to terminate the position of inhouse Delinquent Tax Collector, and in the event that such position is filled by a City employee at the time such action is taken by the Mayor and Council, the Mayor, Council and the City Treasurer shall transfer the existing Delinquent Tax Collector into another position within the City of Washington. Said transfer shall be made to any department of the City which is in need of additional staff or to a newly created position, as determined at the discretion of the Mayor and Council. Said position may be a nonunion management position or may be a position within a bargaining unit of the City of Washington, at the discretion of the Mayor and Council. Upon such transfer, the employee being transferred shall then, upon obtaining his/her new position, be paid the existing salary for the new position at the time of transfer.
A. 
The Delinquent Tax Collector, so long as the same is utilized by the City of Washington, shall be directly accountable for the performance of the tax clerks with regard to the timely and accurate collection and accounting of all delinquent Act 511[1] taxes for the City.

B. 
The Delinquent Tax Collector shall report directly to and be supervised by the Councilperson in charge of accounts and finances of the City of Washington. In addition, the City Treasurer may also familiarize himself with the duties of the Delinquent Tax Collector and make recommendations to the Mayor and Council with regard to the job performance of said Delinquent Tax Collector.
A. 
The following job description shall set forth the essential duties, functions and responsibilities of the Delinquent Tax Collector:
(1) 
Consistently adhere to the tax collection procedures and policies as described in Chapter 325, Taxation, of this Code and Act 511.[1]

(2) 
Ensure that all delinquent taxes are collected timely and posted accurately to the appropriate account and that all inquires and problems are handled professionally.
(3) 
Recommend and implement policy and/or procedural changes in delinquent tax collection methods as appropriate to assist in litigation of delinquent tax matters and increase quality of operation.
(4) 
Communicate with all appropriate agencies, businesses, internal departments and the Washington School District, and other appropriate individuals or entities regarding tax matters.
(5) 
Prepare statistical reports monthly for City management and the Washington School District and other appropriate individuals or entities, identifying collections to date, delinquencies, projections for the year and special reports, as directed.
(6) 
Take appropriate action on all delinquencies, including, but not limited to, filing suit, entering into repayment agreements setting terms and amounts to be paid, wage attachments, filing notices to the magisterial district judge for collection, filing for liens and follow-up on all delinquencies until disposition.
(7) 
Supervise and evaluate the job performance of all employees in the delinquent tax collection function, as defined by the City.
(8) 
Assist the City Solicitor in preparing claims for court proceedings.
B. 
The listing of duties and equipment used to fulfill the full scope of the position requirements are by example only and not limited to those outlined and set forth above.
C. 
Physical demands. The following shall set forth the essential physical demands required for performance of the Delinquent Tax Collection position:
(1) 
Lifting.
(2) 
Climbing/walking.
(3) 
Stooping/bending over/twisting.
(4) 
Reaching/pushing.
(5) 
Speaking.
(6) 
Hearing required.
(7) 
Vision, corrected vision to 20/20.
D. 
Environmental demands. The following shall set forth the essential environmental demands required for performance of the Delinquent Tax Collector position:
(1) 
Inside.
(2) 
Noise/vibrations.
(3) 
Hazards.
(4) 
Dust/odors.
E. 
Qualifications. The following shall set forth the qualifications required of the Delinquent Tax Collector position:
(1) 
High school graduate or GED required. Advanced training or business school preferred.
(2) 
Minimum of three years of tax collection experience, particularly in Act 511 taxes.
(3) 
Excellent communication (verbal and written) and interpersonal skills.
(4) 
Ability to solve problems, handle conflict tactfully, and strong attention to detail is essential to this position.
(5) 
Must possess typing and PC skills.

The aforementioned job description is not limited to the specific duties and responsibilities as set forth above. The employee may be required to perform duties of a similar or comparable nature and/or assist with projects or assignments as are required by the City of Washington.
