There is hereby created and established for the Borough of Burnham
a Recreation Board which has consisted of seven members but which
shall consist of five members as of December 1, 1993. This reduction
shall be effectuated by allowing the terms to expire and by making
no new appointments except to fill the vacancy in the membership of
the present Board which consists of five positions, two terms of which
shall expire on December 1, 1993, and three terms of which shall expire
on December 1, 1994. The sixth and seventh positions on the Board
have been permitted to remain unfilled.

Members shall be appointed to the Recreation Board by the Borough
Council of the Borough of Burnham, and vacancies on said Board shall
be filled by said Borough Council. Appointments to fill an unexpired
term shall be for the unexpired portion of the term. Initial appointments
shall consist of three members whose terms will expire on December
1, 1970, and four members whose terms will expire on December 1, 1971.
Subsequent appointments shall be for a term of two years. In that
as of December 1, 1992, there were only five members holding office,
three of whose terms expired as of December 1, 1992, and two of whose
terms are to expire as of December 1, 1993, only three persons shall
be appointed for terms expiring December 1, 1994, and only two person
shall thereafter be appointed on or about December 1, 1993, for terms
expiring December 1, 1995, and so on thereafter from year to year.

It is hereby declared to be in the interest of public policy
that membership on the Recreation Board shall be representative of
various geographic areas in the Borough and also representative of
existing civic groups and organizations active in fostering recreational
facilities and activities in the Borough to the extent that the attainment
of this goal is feasible and to the extent that qualified, interested
and active persons are available in the discretion of Borough Council.

The Recreation Board shall elect officers and otherwise organize
as provided by law.

The powers, duties and responsibilities of the Recreation Board
shall be to equip, operate and maintain parks and recreation facilities
under the jurisdiction of the Borough of Burnham, to enlist and use
the support of the citizens of Burnham in the recreation program,
to provide advice and counsel to the Borough Council in matters relating
to parks and recreation, and to engage in lawful activities designed
to raise funds for the purposes herein stated.

The Recreation Board shall have the power and duty to promulgate
rules and regulations relating to the subject matter within its jurisdiction.

The Borough Council may make appropriations to the Recreation
Board to assist in the execution of the purposes of the Board, and
may otherwise assist in carrying out the purposes of the Recreation
Board. Such appropriations shall be provided in the regular budgetary
manners as are other appropriations to organizations supported by
the Borough Council. For the guidance of the Borough Council, the
Recreation Board shall submit an annual report covering its activities
for the past year and its plans for the future as well as its proposed
budget for the forthcoming year. Such annual report and budget shall
be submitted to the Borough Council on or before November 1 of each
year.

The Recreation Board shall have the right to enter into contracts
to the extent that it has the funds in hand or committed to meet its
obligations but shall have no right to obligate the Borough Council
on contracts or other obligations or to anticipate appropriations
until same are actually committed.
