1. Sidewalks shall not be less than four inches in thickness and shall
be a minimum of four feet wide from the property line to the curb,
except along collector and arterial streets, and in the vicinity of
shopping centers, schools, recreation areas and other community facilities,
where they shall be a minimum of five feet wide.
2. For purposes of this Part the definitions of "collector" and "arterial" streets shall be that as set forth in Chapter
27, Zoning, Part
3, Definitions, § 302 under the definition in relation to "Road Classification" therein, of the Borough of Burnham Code of Ordinances, which definitions are hereby incorporated herein by reference as if fully set forth.

It shall be the duty of the owner or owners of all the lots
of ground fronting upon the streets and highways of the Borough of
Burnham to pave and curb the side or footwalks along and in front
thereof, to repair and keep the same at all times in a safe and passable
condition and to renew and relay said sidewalks and renew and reset
said curbs whenever unsafe or worn out as hereinafter provided.

All sidewalks shall be constructed of concrete and shall have
an aggregate base course of at least six inches of compacted cinder,
gravel or crushed stone. While it is permissible for sidewalks to
have "separate" curbing (as opposed to "monolith" curbing) which is
at least six inches in width and which is otherwise in accord with
the hereinafter set forth specifications as to depth and "reveal,"
all sidewalks shall, at a minimum, have "monolith" curbing at least
22 inches in depth, which shall include a minimum six inch "reveal"
or smooth outside surface, shall be constructed of concrete, shall
be dressed and finished as to be uniform in height, with a smooth
top surface. In addition, there shall be "tooled" joints across the
sidewalk at a maximum distance between joints of six feet and there
shall be expansion joints at a maximum distance of every 30 feet.

The slope of all sidewalks shall be 1/8 of an inch to the foot
from the property line to the curb line. Every sidewalk shall be laid
and every curb shall be set to conform to the established grade of
the street upon which it abuts, to be given by the Borough Engineer
to the property owner before any sidewalk is laid or any curb is set.

If the owner or owners of any lots as aforesaid shall neglect
or refuse to pave the side or footwalks or set the curbs along and
in front thereof or to keep the same at all times in a safe and passable
condition, or to renew said side or footwalk or renew and reset said
curbs when the same shall become worn out or unsafe, then the Council
of said Borough shall cause a written notice to be served upon the
owner or owners aforesaid requiring them to lay said sidewalk or set
said curb or repair or renew the same as the case may be within 30
days from the source of said notice and upon the failure of the owner
or owners to comply with said notice and lay said sidewalk or set
said curb or repair or renew the same as the case may be within 30
days from the service thereof, the Borough authorities shall procure
the necessary labor, tools and appliances and do said work and collect
the costs and expenses and 10% additional, together with all charges
and expenses from said owner or owners by municipal lien against the
property along and in front of which said work is done by action of
assumpsit.

1. Any person who shall fail, neglect or refuse to comply with any of
the provisions of this Part or any written notice served under the
provisions hereof, shall, upon conviction thereof, be sentenced to
pay a fine of not more than $600 plus costs and, in default of payment
of said fine and costs, to a term or imprisonment not to exceed 30
days. Each day that a violation of this Part continues shall constitute
a separate offense.
2. The term "person" as herein used shall include every natural person,
corporation, firm, partnership, association or other form of incorporated
enterprise owned by two or more persons. As used in this Section,
the term "person" when applied to firms, partnerships or associations
shall mean the partners or members thereof and when applied to corporations,
the officers thereof.
