1. For the purposes of this Chapter, the Borough is hereby divided into
six types of districts, which are located as indicated on the attached
Zoning Map which has been amended to exhibit the same, and which districts
shall be designated as follows:
A. R-1A Rural Residential District.
B. R-1 Low Density Residential District.
C. R-2 Medium Density Residential District.
D. R-3 High Density Residential District.
E. C-1 General Commercial District.
2. Additionally, there are four floodplain districts as follows:
B. FF Flood-Fringe District.
C. FA General Floodplain District.
D. FE Special
Floodplain District.

1. The boundaries of said districts shall be shown upon the map, as
amended, and as attached hereto and made a part of this Chapter which
shall, except those treated as floating zones, be designated "Zoning
Map." The same map and all the notations, references and other data
shown thereon is hereby incorporated by reference into this Chapter
as if all were fully described herein.
2. The boundaries of the floodplain districts are established as shown
on the Official Zoning Map of the Borough of Burnham which is declared
to be a part of this Chapter and which shall be kept on file at the
Burnham Borough offices.

Where uncertainty exists as to the boundaries of any district
as shown on said map, the following rules shall apply:
A. District boundary lines are intended to follow or be parallel to
the center line of streets, streams, and railroads; and lot or property
lines as they exist on a recorded deed or plan or record in the Mifflin
County Recorder of Deeds office at the time of the adoption of this
Chapter, unless such District boundary lines are fixed by dimensions
as shown on the Zoning Map.
B. Where a district boundary is not fixed by dimensions and where it
approximately follows lot lines, and where it does not scale more
than 10 feet therefrom, such lot lines shall be construed to be such
boundaries unless specifically shown otherwise.
C. In unsubdivided land or where a district boundary divides a lot,
the location of such boundary, unless the same is indicated by dimensions,
shall be determined by the use of the scale appearing on the maps.

1. In case of any uncertainty, the Zoning Hearing Board shall interpret
the intent of the map as to location of district boundaries.
2. Initial interpretations of the boundaries of the floodplain districts
shall be made by the Zoning Officer. Should a dispute arise concerning
the boundaries of any of the floodplain district, the Zoning Hearing
Board shall make the necessary determination. The person questioning
or contesting the location of the district boundary shall be given
a reasonable opportunity to present his case to the Board and to submit
his own technical evidence if he so desires.

1. The delineation of any of the floodplain districts may be revised
by the Borough Council where natural or man-made changes have occurred
and/or more detailed studies conducted or undertaken by the U.S. Army
Corps of Engineers River Basin Commission or other qualified agency
or individual documents the need for such change. However, prior to
any change, approval must be obtained from the Federal Emergency Management
Agency (FEMA), or successor Federal agency, all per the National Flood
Insurance Act of 1968, as amended and supplemented, 42 U.C.S.A. § 4001
et seq.
2. Those parcels of land now or formerly owned by the Board of Trustees
of the Young Men's Christian Association of Juniata Valley, Inc.,
by deeds recorded in Mifflin County Deed Book 201 at Page 175 (referred
to as Mifflin County Tax Map Parcel No. 08-13-400) and in Mifflin
County Deed Book 203 at Page 612 (referred to as Mifflin County Tax
Map Parcel No. 08-10-400), respectively, and which parcels are collectively
bounded on the south by First Avenue, on the west by a public alley,
on the north by Second Avenue and on the east by Beech Street and
Lot No. 214 in a plan of lots recorded in Mifflin County Deed Book
1-3 at Page 470, are hereby rezoned and the zoning map is hereby amended
to reflect the change of zoning for said parcels of land from R-3
High Density Residential District to C-1 General Commercial District.
3. Those parcels of land situated in the Borough of Burnham bounded
on the southeast by Ninth Avenue, on the southwest by Edwardtown Road,
on the northwest by the Borough line, and on the northeast by the
center line of an unopened alley which abuts the Borough line and
property now or formerly of Arthur E. Huffnagle and Madeline M. Huffnagle
(for Huffnagle deed see Mifflin County Deed Book 232 at Page 768),
which parcels include Mifflin County Tax Map Parcel Nos. 08-02-100,
08-02-103, 08-02-105, 08-02-107, 08-02-107A, 08-02-111, 08-02-201,
08-02-201A, 08-02-201B, 08-02-207, 08-02-208, 08-02-209, 08-02-209A,
08-02-302, 08-02-304, 08-02-401, 08-02-402, 08-02-404, 08-02-405 and
a portion of the premises of now or formerly of Freedom Forge Corporation
(Standard Steel), are hereby rezoned and the zoning map is hereby
amended to reflect the change of zoning for said parcels of land from
R-1 Low Density District to R-2 Medium Density Residential District,
all as set forth on the Zoning Map, as revised, and as attached hereto
and made part of this Chapter.
4. The following parcels are hereby zoned and the zoning map is hereby
amended to reflect the change of zoning for said parcels of land from
R-1 Low Density Residential District to R-2 Medium Density Residential
District, all as set forth on the Zoning Map, as revised, and as attached
hereto and made part of this Chapter:
A. Property now or formerly of John S. Manbeck, Jr. and Carol Ann Manbeck,
Mifflin County Deed Book 179, Page 282, Mifflin County Tax Map Parcel
No. 08-04-318A.
B. Property now or formerly of Frank T. and Mary T. Evanitsky, Mifflin

being premises now or formerly of Lewistown Trust Company (now Juniata
Valley Bank), by deed recorded in Mifflin County Record Book 350 at
page 65, Mifflin County Tax Map Parcel No. 08-21-0118, abutting Logan
Boulevard on the Northeast and Mifflin County Tax Map Parcel No. 08-21-0119,
property now or formerly of Gary L. Oden, and Cedar Street on the
southeast and premises now or formerly of Gary L. Oden by deed recorded
in Mifflin County Record Book 408 at page 166, Mifflin County Tax
Map Parcel No. 08-21-0119, abutting Logan Boulevard on the northeast
and Cedar Street on the southeast, respectively, are hereby rezoned
from R-1 Low Density Residential to C-1 General Commercial.
6. That parcel
of land presently zoned R-2 Medium Density Residential, being premises
now or formerly of Leslie B. Hetrick, by deed recorded in Mifflin
County Record Book 555 at page 226, identified as Mifflin County Tax
Map Parcel No. 08-10-0402, abutting Second Avenue on the northwest
and known as 112 Second Avenue, Burnham, Pennsylvania, is hereby rezoned
from R-2 Medium Density Residential to C-1 General Commercial.

of land presently zoned R-1 Low Density Residential, being premises
now or formerly of Allen H. Bingman and Danna J. Bingman, by deed
recorded in Mifflin County Record Book 570 at page 1965 et seq., previously
part of Mifflin County Tax Map Parcel No. 08-14-0200, abutting South
Walnut Street, and being designated as “LOT A” on a Subdivision
Plan for Faye A. Foster prepared by Sarge Engineering and Surveying
dated June 1, 2007, and recorded in the Recorder’s Office of
Mifflin County, Pennsylvania, in Plan Book 24, Page 114, and containing
0.140 acre, is hereby rezoned from R-1 Low Density Residential to
C-1 General Commercial.

8. That parcel
of land presently zoned R-3 High Density Residential, being premises
now or formerly of Standard Steel Employees Federal Credit Union,
by deed recorded in Mifflin County Record Book 567 at page 571 et
seq., identified as Mifflin County Tax Map Parcel No. 08-13-0105,
abutting North Walnut Street on the west and known as 107 North Walnut
Street, Burnham, Pennsylvania, is hereby rezoned from R-3 High Density
Residential to C-1 General Commercial.
