This article shall be known as the "Jefferson Borough Engine Brake Ordinance."
No gasoline-powered or diesel-powered motor vehicle shall operate an engine brake not equipped with exhaust mufflers, or equipped with defective or modified exhaust mufflers, so as to create excessive noise through the use of said engine brake on the following roads:
A. 
The length of Route 516 running north/south through the Borough, also known as "Baltimore and Berlin Streets," shall be included in their entirety and the length of the major east/west corridor of the Borough including the totality of York and Hanover Streets within the Borough of Jefferson, York County, Pennsylvania.
This article shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of Jefferson Borough, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation.
This article shall not apply to fire or emergency vehicles requiring the utilization of an engine brake to protect the safety and property of the residents of Jefferson Borough, other motor vehicle operators, pedestrians, and the operator and passengers of the fire or emergency vehicle.
Any person, firm, corporation or organization violating any of the provisions of this article shall, upon summary conviction before a District Magistrate having jurisdiction, be sentenced to pay a fine of not more than $500 and costs of prosecution and, in default of the payment thereof, shall be sentenced to undergo imprisonment in the York County jail for a period not to exceed 10 days.
