Township of Bear Creek, PA Chapter 17 Finances and Funds

Article I Wind Park Fund

[Adopted 3-7-2005 by Ord. No. 1-2005; amended in its entirety 4-17-2006 by Ord. No. 2-2006]

§ 17-1 Fund established.

The Township of Bear Creek hereby establishes the Wind Park Fund designed and intended to be funded from the proceeds derived from the payments made to the Township for the Wind Park(s), plus any additional amounts which may be added from time to time.

§ 17-2 Opening of account.

The Board of Supervisors is hereby authorized to open and establish an interest-bearing account with a federally insured, reputable financial institution to accept said proceeds.

§ 17-3 Use of funds.

The Board of Supervisors shall be permitted to use these funds only upon consent by a majority of the Board Members and only for the following uses:

A. The partial or full abatement of real property taxes.

B. Municipal buildings.

C. Acquisition of land for general municipal use.

D. Recreation activities and facilities.

E. Windmill expenses (zoning, consultant fees, etc.).

F. Roadways within Bear Creek Township.

G. Planning Commission and Zoning Board expenses.

H. Act 537[1] sewage update.

§ 17-4 Funds to be kept separate.

Any and all amounts generated as part of the Wind Park Fund shall be kept separate from the Township's General Fund and shall not, at any time, be used for balancing the General Fund Budget or to recoup shortfalls.

§ 17-5 Contributions to account.

Contributions may be made to the account by the Board of Supervisors under the same conditions set forth herein, regardless of whether the proceeds are generated from the Wind Park.
