The fee required by this Part is the municipal review fee. The municipal review fee shall be established by the municipality from time to time by resolution to defray review costs incurred by the municipality and the Municipal Engineer and professional consultants.[1] The applicant shall pay all fees.

Where applicable, the applicant may be required to execute a development agreement prepared by the Borough of Burnham's Solicitor in accordance with the municipality's Subdivision and Land Development Ordinance and shall be liable for the fees and financial security as set forth therein. The applicant shall pay all fees.

The fees required by this Part shall, at a minimum, cover:
A. 
Administrative and clerical costs.
B. 
Review of the SWM Site Plan and Report by the municipality.
C. 
Preconstruction meetings.
D. 
Inspection of stormwater management facilities/BMPs and drainage improvements during construction.
E. 
Final inspection upon completion of the stormwater management facilities/BMPs and drainage improvements presented in the SWM Site Plan.
F. 
Any additional work required to enforce any permit provisions regulated by this Part, correct violations, and assure proper completion of stipulated remedial actions.
G. 
Fees of professional consultants.

1. 
The owner of any land upon which permanent BMPs will be placed, constructed, or implemented, as described in the SWM Site Plan, shall record the following documents in the Office of the Recorder of Deeds of Mifflin County, within 90 days of approval of the SWM Site Plan by the municipality:
A. 
The SWM Site Plan.
B. 
Operations and Maintenance (O&M) Agreement (Appendix A).
C. 
Easements under § 9.901.
D. 
Riparian buffers under § 9.602.
2. 
The municipality may suspend or revoke any approvals granted for the project site upon discovery of the failure of the owner to comply with this Section.
