A.
Definitions.

As used in this chapter, the following words have the meanings indicated.
(2)
"Garbage" means the entrails or waste products of any animal, fish
or fowl; refuse; animal or vegetable matter from a kitchen, market,
store or abattoir; or any admixture of these materials with other
refuse or feeding material.
(3)
"Trash" includes all waste or refuse other than garbage and ashes.
B.
Transportation and disposal; garbage used as feed for hogs. No garbage
shall be transported over any public highway or street of Charles
County except to incinerators, approved municipal dumps in said County
or to destinations outside the limits of Charles County or to farms
in Charles County for the use in the feeding of hogs. No garbage shall
be fed to hogs except in concrete or other watertight containers,
the feed containers to be washed and cleaned at least once in every
24 hours, and no such feeding place shall be located closer than 1,000
feet to any public building or residence, except the residence of
the owner or tenant on such farm where feeding places are established,
unless written consent is obtained from all property owners and tenants
within said 1,000 feet, nor shall such feeding place be located within
1,000 feet of any public highway. Any residue in these containers
for feeding purposes and not devoured by the hogs shall be disposed
of by incineration, plowing under or spread for fertilizing purposes;
provided, however, that no refuse shall be spread for fertilizing
purposes within 1,000 feet of any residence, except that of the owner
or tenant, within 24 hours after any one feeding.
C.
Licensing and equipment regulations for vehicles.
(1)
All garbage transported over any public highway or street of Charles
County to incinerators, approved municipal dumps or to destinations
outside the limits of Charles County shall be transported only in
vehicles equipped with covered watertight, leakproof bodies in metal
containers with tight-fitting covers. The County Health Officer shall
have the power and authority to license the vehicles that are used
for the purpose of hauling said garbage, and each operator shall pay
an annual license fee of $25 for each vehicle used, the revenues from
such licenses to be retained by the County Health Officer to defray
the cost of inspection service for the enforcement of this subsection;
provided, however, that this subsection shall not apply to vehicles
operated by any incorporated town of Charles County, Maryland.
(2)
All trash transported over any public highway or street of Charles
County shall be so transported only in vehicles or containers equipped
with tight-fitting covers, which shall be secured in transit.
D.
Penalty provisions. Any person violating the provisions of this chapter
shall be deemed guilty of a misdemeanor and, upon conviction thereof,
shall be punished by a fine of not less than $5 nor more than $50.
