These Articles of Organization are adopted pursuant to the provisions of the Housing and Community Development Article of the Annotated Code of Maryland.
It is declared that there is a need for a housing authority in Charles County, Maryland.
The name of the authority (hereinafter called the "Authority") shall be the "Housing Authority Board of Charles County, Maryland."
There shall be seven Commissioners of the Authority, who shall be residents of Charles County, Maryland, and shall be appointed by the County Commissioners of Charles County, Maryland, to serve terms of five years.
The Director of Community Services shall serve as the custodian of records for the Housing Authority Board.
Subject to the approval of the County Commissioners of Charles County, Maryland, the Authority is empowered to exercise all of the powers set forth in Section 12-503 of the Housing and Community Development Article of the Annotated Code of Maryland.
The Authority shall secure the approval of the County Commissioners of Charles County, Maryland, prior to exercising the powers granted by the following sections of the Housing and Community Development Article of the Annotated Code of Maryland:
A. 
Section 12-502, Subsections (c), (d), (e), (h), and (j).
B. 
Section 12-506.
C. 
Section 12-507.
D. 
Sections 12-701, 12-702, 12-703, 12-704, and 12-705.
Notwithstanding the provisions of Sections 12-305 and 12-308 of the Housing and Community Development Article of the Annotated Code of Maryland:
A. 
The County Commissioners of Charles County, Maryland, shall designate one of the Commissioners of the Authority as Chairman. The initial Chairman shall be selected upon the approval of these Articles of Organization by the Secretary of State. Thereafter, the County Commissioners of Charles County, Maryland, shall annually designate one of the Commissioners as Chairman for a one-year term, beginning on the first day of January.
B. 
Legal services required by the Authority shall be provided by the Office of the County Attorney.
C. 
The power of the Authority to employ a secretary, technical experts and other officers, agents and employees shall be subject to the approval of the County Commissioners of Charles County, Maryland.
In the operation of its housing projects, the Authority shall give preference to residents of Charles County, Maryland.
The financial records, accounts and bank accounts of the Authority shall be maintained in the manner and form, and at such banking institutions, as may be required by the County Commissioners of Charles County, Maryland.
