The purpose of this chapter shall be to ensure the safety of
the citizens of the Village of Lancaster and to prevent the unnecessary
disposal of refuse, landfill and other materials within the Village
by prescribing a uniform grade level at which vacant lots shall be
maintained.
As used in this chapter, the following terms shall have the
meanings indicated:
A grade of land which is roughly level, allowing for slope
deviations for drainage. Minor deviations to the grade caused by natural
formations shall also be permitted.
Any parcel of land which is empty and devoid of any structure,
which may include, however, land which adjoins or is part of a parcel
of land which contains a structure or building.
A.
All vacant lots within the Village of Lancaster shall be maintained
at a uniform grade level so as not to endanger pedestrian traffic
or to create a safety hazard.
B.
If it is determined that a hazardous condition exists due to the
dumping of landfill or other materials or of any other artificial
variation in grade, the Building Inspector of the Village of Lancaster
shall send notice to the owner of the property, by registered mail,
describing the condition to be remedied and allowing the owner 10
days to remedy the condition.
C.
If the owner does not comply with the notice, the Building Inspector
shall have the lot leveled to a uniform grade with Village equipment.
A.
If a vacant lot is leveled by order of the Building Inspector, pursuant
to this chapter, the owner of the property shall be assessed a reasonable
charge for the costs incurred.
B.
Upon the failure of the owner and/or occupant of any premises subject
to any charges pursuant to this section to pay to the Village of Lancaster
the amount of said charges within 10 days after receiving a statement
of said charges from the Village of Lancaster, the balance of such
charges, together with interest, shall be added to the tax roll of
the Village of Lancaster and shall become a lien against said premises
in the same manner as regular Village property taxes and shall be
subject to penalties and subsequent collection by the Village of Lancaster
in the same manner as any other delinquent real property tax would
be collected.
If any provision of this chapter is inconsistent with any federal
or state statute, law, rule or regulation, then such statute, law,
rule or regulation shall prevail.
