It is the intent of the Upper Moreland Township Transit Management Overlay District to serve as an overlay district in order to provide easy and convenient access to retail stores and financial institutions for those who utilize and rely on public transportation, including, but not limited to, SEPTA, in the Township of Upper Moreland. It is also the intent of the Upper Moreland Township Transit Management Overlay District to provide convenient access to retail stores and financial institutions for those visiting the area to enjoy the Memorial Creek and Veterans Memorial Park.
The Upper Moreland Township Transit Management Overlay District shall be an overlay to the Town Center zoning districts as depicted on the Upper Moreland Township Zoning Map.[1]

A lot or lots may be occupied or used for any of the following purposes, and no other:
A. 
All uses allowed in the Town Center Zoning District, and other such accessory uses which are permitted in the underlying zoning district are permitted.[1]

B. 
Financial institution, consisting of a bank or savings-and-loan association, including drive-through facilities.
C. 
Establishment serving food or beverages to the general public, such as, but not limited to, a restaurant, cafe, taproom, tavern, retail bakery, confectionary or ice cream shop, including walk-up windows and drive-through facilities.
A. 
Any tract of land to be developed under this overlay district shall have access points on to two PennDOT highways.
B. 
A maximum of three buildings may be erected, altered or used for the first three acres of a lot or lots, and one additional building shall be permitted for every five acres contained in such lots thereafter.

C. 
The following dimensional standards shall apply:
(1) 
Minimum lot size: 3.0 acres to the ultimate right-of-way line (inclusive of areas within utility easements, steep slopes, floodplain and wetlands).
(2) 
Minimum front yard setback: 40 feet; however, a minimum front yard setback of 15 feet shall be permitted where the property fronts on a Township road and the maximum building heights of the nearest adjacent commercial or residential buildings on the property are no more than 35 feet from average surrounding grade. A minimum front yard setback of 15 feet shall be permitted where the property fronts on a state or county road by grant of special exception and the maximum building heights of the nearest adjacent commercial or residential buildings on the property are no more than 35 feet from average surrounding grade.

(3) 
Minimum rear yard setback: 45 feet.
(4) 
Minimum side yard setback: 45 feet.
(5) 
Maximum building height: 45 feet.
(6) 
Maximum building coverage per lot: 40%.
(7) 
Maximum impervious coverage per lot: 80%.
(8) 
Maximum continuous linear footage of a single building along a Township road shall not exceed 200 feet.

D. 
Multiple parcels of land proposed for development shall be under single and separate ownership, shall be subject to a covenant to develop as a unified application, or shall be developed in concert with a reverse subdivision.
E. 
The applicant shall incorporate design elements as must be approved by the Board of Commissioners in accordance with the Township Subdivision and Land Development Ordinance[1] as follows:
(1) 
Buffer plantings, ornamental lighting, masonry walls, masonry piers and ornamental sidewalks to include brick, brick look-alike material, or brick look-alike stamped concrete on every fourth section of sidewalk.
(2) 
Any canopy over a gasoline filling pump shall be A-frame construction.
(3) 
The roof on any retail sales building shall be constructed of a standing seam material, a canopy over any gasoline filling pumps will be constructed with the same standing seam material that is used on any retail sales building.
(4) 
The applicant shall provide pedestrian crosswalks to and from any train station or other mass transit hub within 200 feet of the development, which shall be delineated by painted macadam and of a design approved by the Board of Commissioners.
(5) 
All existing sidewalks shall be replaced pursuant to the standards contained herein.

Parking shall be provided pursuant to §§ 350-178 and 350-264 of the Upper Moreland Township Zoning Ordinance. Parking shall be permitted up to the ultimate right-of-way line and within five feet of a side or rear of property line. The maximum parking limitations contained in § 350-264B(1) shall not apply. The Township Board of Commissioners, upon the advice of the Township staff, Police Department and Township consultants, may approve a plan that modifies the standards in an effort to comply with other provisions of this overlay district.
The loading, unloading and waste disposal requirements of § 350-178C of the Upper Moreland Township Zoning Ordinance shall apply, with the exception that loading, unloading and waste disposal areas shall not be required for banks and other financial institutions.

Any tract of land to be developed under this overlay district shall not be required to comply with any requirements of the underlying Town Center Zoning District, other than those specifically incorporated herein. No other requirements of the Upper Moreland Township Zoning Ordinance shall apply other than the provisions contained in Article XIX, Floodplain Conservation District, and provisions contained in Article XX, Steep Slope Conservation District.
