This article is adopted in order to assure preservation of public health and safety in the Village of Bellevue, and in order to maintain a system of surface water sewers or stormwater sewers, and under the authority of § 61.36, Wis. Stats.

All drains of whatever nature and from whatever source used for the purpose of collecting, transporting, diverting, draining, or discharging clear waters shall be discharged into a storm sewer wherever possible. In cases where there is no storm sewer available, such drains shall be allowed to discharge onto the owner's lawn or into an underground conduit leading to a drainage ditch, gutter or dry well, but no such discharge shall be allowed or permitted to flow on or across a public sidewalk or curbline.

Under no circumstances shall any discharge as described in the preceding section be permitted to enter into any sanitary sewer or conducted into any sanitary sewer.
Discharge of clear water from eaves, downspouts, drain tiles, sump pumps or by any other means into a sanitary sewer is prohibited.

All storm sewer laterals constructed on public rights-of-way or on private property, or on both, shall be fully paid for by abutting property owners pursuant to written agreement or special assessment.
All storm sewers installed shall be considered a benefit to the adjacent property owner and shall be paid for by such owners by special assessment according to the following schedule:
A. 
Storm sewers zero inches to 18 inches in diameter: paid in full by adjacent property owners.
B. 
Storm sewers 19 inches to 30 inches in diameter: paid for by Village, less cost of eighteen-inch sewer to be paid for by adjacent property owners.
C. 
Larger storm sewers: shall require special action of the Village Board.
All driveway culverts shall be concrete or steel and shall not be less than 15 inches in diameter without special permission from the Village Board or its designated representative. Rigid headwalls made of concrete, asphalt, stone, brick, and wood, etc., on driveway culverts shall not be allowed. Side slopes at the culvert ends shall be no steeper than 2 to 1.
Surface water sewers, ditches, drains, etc., shall not be filled, deepened or in any way altered without prior permission of the Bellevue Village Board or its designated representative.
No building permits shall be issued for the construction of any building unless the plans and specifications show clear water drainage and connections in compliance with this article.
No subdivision shall be given preliminary approval by the Village Board until the Board and Village Engineer have checked the subdivision for drainage easement compliance and adequacy in accordance with the Bellevue Storm Sewer Master Plan and made a preliminary cost estimate thereof. After the subdivision is staked by the owner, and upon final approval by the Village Board, the Village will order the Village Engineer to draw the plans and cause the installation of the storm sewers and drainage structures by normal procedure. The cost of this work shall be handled as detailed in § 400-34 above.
Except as otherwise provided, any person found in violation of this article or any order, rule, or regulation made hereunder shall be subject to the penalty provided in § 1-4 of the Code of the Village of Bellevue.
