The officers of the Fire Department, namely, the Chief, First and Second Assistant Chiefs, Chief Engineer and Assistant Engineer, shall be appointed from the membership of the Fire Department by the Mayor, with the advice and consent of the Council, for a term of one year starting January 1 and shall hold office for said term or until a successor shall be appointed.

The Morris Plains Fire Association may submit to the Mayor and Council recommendations as to the officers appointed pursuant to Section 10-7. The recommendations shall be determined by the Association, by secret written ballot, at a meeting of said Association to be held during the first week in December in each year, said meeting to be called by the President of the Association, upon notice to be mailed by the Secretary of the Association to each member of the association, at least one week in advance of the meeting. Such recommendations, in order to receive consideration, shall be submitted to the Mayor on or before December 15 in each year.

(a) 
Every such officer shall have the same qualifications as hereinafter specified for members of the Fire Department. Every officer of the Fire Department shall have the same qualifications as hereinafter specified for members of the Fire Department, as well as successful completion of such additional training as required by law for the respective office.
(b) 
The Council may, by rule or regulation, set additional qualifications for officers.

The Chief shall be the commander of the fire company or companies at all times. He will be held responsible for the discipline in the Fire Department. In the absence of the Chief, his duties shall be performed by the First Assistant Chief, and in the absence of both the Chief and the First Assistant Chief, his duties shall be performed by the Second Assistant Chief. In the absence of the Chief and both assistant chiefs at any fire, the duties of the Chief shall be performed by the first arriving ranking officer of a patrol; or of a company if more than one company has been established under this chapter.

Each officer of the Fire Department shall be furnished with a badge of his office, which he shall wear as an emblem of his authority. Every such badge shall be and remain the property of the Borough and upon the termination of said office, either by expiration of term, death, resignation or removal, shall be surrendered to such Borough officer authorized by the Council to receive it. Upon receiving a leave of absence, such badge shall be so surrendered if the Council shall so provide, and in such case shall be returned to such officer at the expiration of his leave.

Any officer of the Fire Department shall be subject to removal, as such officer, by the Council for good cause at any time upon notice and hearing.[1]
