Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[2] the New Jersey Uniform Fire Code N.J.A.C. 5:70-1.1 et seq., shall be locally enforced in the Borough of Morris Plains.

The local enforcing agency shall be the Bureau of Fire Prevention within the Morris Plains Fire Department.

(a) 
The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Borough of Morris Plains, other than owner-occupied one-family and two-family dwellings used exclusively for dwelling purposes, and buildings, structures and premises owned or operated by the federal government, interstate agencies or the state.

The local enforcing agency shall faithfully comply with the requirements of the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et seq. and the Uniform Fire Code, N.J.A.C. 5:70-1.1 et seq.

The local enforcing agency established by Section 11-2 of this chapter shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by Section 11-2 of this chapter shall be the Bureau of Fire Prevention within the Morris Plains Fire Department and shall be under the direct supervision and control of the Fire Official, who shall report to the Chief of the Morris Plains Fire Department.

(a) 
The local enforcing agency shall be under the direct supervision of the Fire Prevention Official of the Bureau of Fire Prevention within the Morris Plains Fire Department, who shall be appointed by the Mayor and confirmed by the Borough Council upon the recommendation of the Morris Plains Fire Association.
(b) 
The Fire Official shall serve for a term of one year.
(c) 
Such inspectors and other employees as may be necessary in the local enforcing agency shall be appointed by the Mayor and confirmed by the Borough Council upon the recommendation of the Morris Plains Fire Association.
(d) 
Inspectors and other employees of the local enforcing agency shall be subject to removal by the Mayor and confirmed by the Borough Council upon the recommendation of the Chief of the Morris Plains Fire Department or the Fire Official.
(e) 
The Fire Official shall be subject to removal by the Mayor and confirmed by the Borough Council upon the recommendation of the Chief of the Morris Plains Fire Department.

The local enforcing agency, in addition to any other reporting requirements delegated to it under the Code, shall make a report each month to the Borough Council through the Public Safety Committee. The reports shall contain all information, including inspection reports, correspondence, notices and orders relevant to all proceedings under the Code. The reports shall be included in the monthly report prepared by the Chief of the Morris Plains Fire Department.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Morris County Construction Board of Appeals in accordance with the procedures set forth in N.J.A.C. 5:70-2.19 et seq.

In addition to the fees and inspections of life-hazard uses pursuant to the New Jersey Uniform Fire Code, the additional inspection and fees relative to the non-life-hazard uses as set forth in the Fee Schedule of the Borough of Morris Plains shall be required. These uses shall be inspected at least once per year and shall pay an additional inspection fee for each such inspection. The additional inspection fee in the amount set forth in the Fee Schedule of the Borough of Morris Plains, Chapter 2, Section 2-46, of the Revised Ordinances, shall be paid to the Bureau of Fire Prevention of the Borough of Morris Plains within 15 days of each inspection.

The permit fees shall be those established by the Uniform Fire Code as set forth in the Fee Schedule of the Borough of Morris Plains, Chapter 2, Section 2-46, of the Revised Ordinances.

Chapter 11 of the Revised Ordinances of the Borough of Morris Plains, New Jersey, 1972, is hereby repealed in its entirety and replaced with this chapter. Said repeal shall be effective as of the enactment of this chapter.

The Borough of Morris Plains specifically appoints and designates the Borough Attorney to assist the local enforcing agency to enforce the Code. The Borough Attorney shall advise the agency and undertake such actions at law as shall be necessary to gain compliance with the Code.

Any person who violates any provision of this chapter shall be punished for each violation pursuant to the penalty provisions of N.J.A.C. 5:70-2.12 et seq., as may be amended from time to time.

If any section, subsection, sentence, clause or phrase of this chapter is, for any reason, held by a court of competent jurisdiction to be invalid, such a decision shall not affect the validity of this chapter.

This chapter shall take effect upon its enactment after publication thereof in accordance with law.
