As used in this article:
BRUSH, WEEDS and DEBRIS
And refers to and includes brush, weeds, including ragweed, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and other debris.

The building inspector of the Borough is hereby constituted and appointed as the enforcement officer under this article.

Whenever the Building Inspector shall deem it to be necessary and expedient for the preservation of the public health and general welfare, or to eliminate a fire hazard, the owner or tenant of lands lying within the Borough shall remove from such lands or destroy brush, weeds and debris within ten (10) days after notice to remove or destroy the same.
Any owner or tenant who fails or neglects to comply with the notice served as provided in Section 12-7 hereof and within the time prescribed therein shall be subject to the penalty prescribed in Section 12-10 hereof.

(a) 
If, after giving of the said ten-day notice by the Building Inspector or other person designated by the Council, the owner or tenant shall have refused or neglected to remove or destroy such brush, weeds and debris, then the Building Inspector or Council shall cause such brush, weeds and debris set forth in said notice to be removed or destroyed, and the cost thereof shall be certified to the Council.
(b) 
If the Council, after examining the certificate, finds the cost to be correct, it shall cause the cost to be charged against said lands as set forth in N.J.R.S. 40:48-2.14. Such charge shall become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.

(a) 
Any person who violates the provisions of Section 12-8 of this Article shall, upon conviction thereof, be punished in accordance with Section 1-9 of these Revised Ordinances.
(b) 
The imposition of the penalty provided for in Paragraph (a) of this section shall not constitute a bar to, or be deemed in substitution of, the exercise of the right and power of the Borough provided for in Section 12-9 hereof.
