Use of the swimming pool (defined in Section 16-1) shall be limited to residents of the Borough of Morris Plains and a limited number of nonresidents who obtain pool membership and to their guests, as hereinafter defined, upon the payment of such fees as shall be established from time to time by resolution of the Borough Council.

Use of the swimming pool by pool members and their guests shall be subject to the following rules and regulations:
(a) 
Guests of a family or individual may enjoy the use of the pool, provided that they are accompanied by a member and further provided that the requisite fee is paid.
(b) 
Each individual constituting the family membership and each individual member shall be issued by the Secretary of the Board of Recreation Commissioners a numbered membership badge which shall be conspicuously displayed upon the person at all times within the swimming pool. Admittance to the swimming pool will not be permitted without the badge. Lost badges may be replaced by the secretary of the Board of Recreation Commissioners upon the satisfactory proof of said loss and upon payment of a fee as set forth in the fee schedule.
(c) 
Membership badges are not transferable. Anyone transferring a membership badge will nullify the privileges of membership Represented by said badge, including those of all individuals constituting a family membership, for fifteen (15) days. A second offense will be cause for the revocation of privileges for the entire year and forfeiture of membership fees.

The giving of false information pertaining to membership shall be cause for revocation of privileges for the entire year and forfeiture of membership fees.

(a) 
All persons shall take a cleansing shower in the nude, using soap, before entering the pool. This may be performed at home or at the pool facilities.
(b) 
Use of the wading pool shall be limited to children under eight (8) years of age who must be supervised in addition to any lifeguard by a person who has attained at least his 16th year.
(c) 
Any person showing evidence of skin disease, sore or inflamed eyes, colds, coughs, nasal or ear discharge or any communicable diseases, excessive sunburn, open blisters or cuts, or wearing bandages, shall be refused admission.
(d) 
No glass containers shall be permitted in the pool area.
(e) 
Running, pushing, wrestling, abusive language, profanity or causing any undue disturbance in or about the pool area are prohibited.
(f) 
Toys, balls, inner tubes, snorkels and articles of a similar nature shall not be permitted within the pool area. Swimming aids shall be permitted, provided that they are attached to the person and are approved by the person designated by the Board of Recreation Commissioners to supervise or manage the swimming pool, provided that persons using such aids shall use the shallow end of the pool only.

(o) 
All activities shall be regulated so that no activity shall constitute a public nuisance.
(p) 
Members shall keep the pool and grounds clean by using rubbish containers provided and by observing the rules and regulations promulgated by the Board of Recreation Commissioners.
(q) 
No child ten (10) years of age (as of December 31 of the current year) or less shall be permitted within the pool area unless accompanied by a person who has attained at least his 16th year, which person shall remain in the area and near the child at all times; provided, however, that any child who has at least attained his 11th year may be admitted without supervision upon the successful completion of a swimming examination conducted under the auspices of the Board of Recreation Commissioners and with the written approval of his parents or guardian duly signed.

(a) 
The swimming pool shall be opened for such periods of the year, on such days and for such hours of the day as shall be prescribed by the Board of Recreation Commissioners.
(b) 
The pool manager or chief lifeguard, in his absence, both of whom shall have been duly appointed by the Board of Recreation Commissioners, may close the swimming pool or the pool area whenever, in the judgment of either of them, such action is deemed necessary or desirable because of weather conditions, prevailing light or other conditions, for the protection of the health and safety of the persons using such facilities. The Board of Recreation Commissioners may close the swimming pool for general use for the purpose of such activities and for such periods of time, as may be permitted by law.

All fees, rents or other charges for admission to or use or enjoyment of said swimming pool shall be received by the Borough free from any control of the Board of Recreation Commissioners and shall be kept in an account or accounts of said Borough separate and distinct from any other accounts of the Borough.

The general supervision and control over the maintenance, operation and regulation of the swimming pool and the general supervision and control over programs in the regulation of Community Park is hereby assigned to the Board of Recreation Commissioners heretofore established and continued by Section 6-6 of these Revised Ordinances.

The sale of all beverages, food products or other commodities shall be controlled and managed by the Board of Recreation Commissioners, and the sale of the same otherwise by any person is hereby prohibited in Community Park or the swimming pool except by permission specifically granted by resolution of the Mayor and Council.

Members of the Police Department of the Borough, including special officers on duty, and the custodians, supervisors and assistants, pool managers, chief lifeguard and all other lifeguards when on duty at the swimming pool, all as appointed by the Board of Recreation Commissioners, shall have the power and authority within Community Park or the swimming pool to prohibit any action or conduct which they may consider to be dangerous, improper or immoral or any act or acts in violation of rules and regulations now or hereafter promulgated under this chapter. They shall have the power of expulsion or suspension of the privileges otherwise granted to pool members. The aforesaid persons appointed by the Board of Recreation Commissioners shall, in addition, have all power and authority of police officers of the Borough while on duty and for the purpose of preserving order and the observance of the aforesaid rules and regulations.

The Borough reserves the right with respect to Community Park, or any part thereof, and any facilities located therein, to enter into any agreement with the Board of Education of the Borough concerning the control and use thereof. Anything contained in this chapter to the contrary notwithstanding, any use of said premises or said facilities by said Board of Education pursuant to any agreement with the Borough Council heretofore or hereafter entered into shall be free and exclusive from any control or supervision of or by the Board of Recreation Commissioners.
