(a) 
The Borough Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around road or street construction, maintenance operations or utility work, above or below ground, which requires blocking the roadway and obstructing the normal flow of traffic and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work forces performing these operations.
(b) 
The Manual on Uniform Traffic Control Devices ("manual"), as may be amended from time to time, a copy of which is on file in the Morris Plains Police Department, is hereby adopted and incorporated herein as it pertains to the control and regulation of construction, maintenance operations and/or utility work which obstructs the normal flow of traffic. Said manual is further supplemented by the regulations contained in this chapter. Any person or entity who fails to comply with the provisions of the manual or the regulations herein shall be in violation of this article.

As used in this article, the following terms shall have the meanings indicated:
PERSON or ENTITY
Includes any natural person, sole proprietorship, partnership, firm or corporation, including any public utility.
ROADWAY or STREET
Includes any road, highway, public way, public alley, easement or other right-of-way accepted or maintained by the Borough as a public street, as well as any state or county roadway or highway over which the Borough maintains jurisdiction or control.

It shall be the responsibility of the person or entity wishing to conduct work on, under or above a roadway or any work adjacent to a roadway that will obstruct, interfere with and/or detour traffic on the roadway to contact the Chief of Police of the Borough of Morris Plains, or his designee, prior to the start of any such work in order to arrange a preconstruction meeting for the submission and approval of plans for the safe movement of traffic during such periods of construction or maintenance work. This requirement shall be in addition to any other permit or approval required by any other federal, state or municipal law, ordinance or regulation. Any person or entity who fails to comply with this section prior to the start of such work is in violation of this article.

Prior to the start of any work, the person or entity shall provide the Chief of Police or his designee with the telephone numbers of at least two emergency telephone contact persons to be called in the event of any emergency at the construction or maintenance site, if, for any reason, the designated emergency contact persons cannot be reached or if the person contacted does not respond within a reasonable time to a call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable costs of such emergency services by the Borough shall be charged to the person or entity responsible for such condition.

No construction, maintenance or utility work on, under or above any roadway nor any work adjacent to any roadway that will obstruct, interfere with and/or detour traffic on the road shall be performed before the hour of 9:00 a.m. or after 4:00 p.m., prevailing time. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Chief of Police or his designee. If it is determined by the Chief or his designee that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closings and/or traffic detours shall not be permitted unless approved by the Chief of Police or his designee.

Traffic directors shall be posted at all construction or maintenance sites, when determined by the Chief of Police or his designee that the same are necessary to provide for the safety and expeditious movement of traffic.

The provisions of this article shall be enforced by the Chief of Police. The Chief of Police or his designee shall have the authority to stop work, including directing the removal of equipment, vehicles or stored material within the street right-of-way, the backfilling of open excavations and/or other related work in order to abate any nuisance, safety hazard or unauthorized traffic delay.

In the case of any emergency work to remedy a dangerous condition in accordance with Section 20-15 of this chapter, the person or entity performing such emergency work shall notify the Morris Plains Police Department of the nature and location of such emergency, as well an the estimated hours of operation needed to correct the dangerous condition. All emergency work shall be performed with full regard to safety and to keeping traffic interference to an absolute minimum. There shall be compliance with the provisions of the manual during all emergency work.

(a) 
Any person or entity violating this article shall, upon conviction thereof, pay a fine of not more than $1,000 and/or be imprisoned for a term not exceeding 90 days.
(b) 
Each and every day during or on which a violation occurs or continues shall be deemed a separate offense.
