A Police Department consisting of a Chief of Police, sergeants, corporals, privates first class, privates and probationers hereby is established in the Borough of Gettysburg under and pursuant to Section 1121 of the Borough Code, as amended, 53 P.S. § 46121.

The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention of the Borough of Gettysburg, which is hereby established. The Fire Marshal shall be the Chief of the Bureau of Fire Prevention. The Fire Marshal shall be appointed by the Borough Council and shall serve at the pleasure of the Council. He shall be assisted by such other members of the Bureau of Fire Prevention as shall be appointed by the Borough Council for the purpose.

1. 
In the case of a vacancy in the office of Chief of Police, the Borough Council may nominate a person to the Civil Service Commission, which shall then subject such person to a noncompetitive examination. Borough Council may also appoint a candidate to the office of Chief of Police outside of this noncompetitive examination process.
A. 
The person nominated to the Civil Service Commission for a noncompetitive examination or appointed by Borough Council without nomination to the Civil Service Commission must possess the following qualifications; specifically, such candidate must have:
(1) 
Completed formal training as required by state legislation for police officers;
(2) 
Earned a bachelor's degree in criminal justice or a related field from an accredited college or university;
(3) 
A minimum of 10 years of service as a certified police officer;
(4) 
A minimum of three years of employment in a managerial/supervisory position;
(5) 
Graduated from a recognized law enforcement training institution such as the FBI National Academy, Northwestern University School of Police Staff and Command, the Southern Police Institute, or from an equivalent law enforcement education and training academic program;
(6) 
The ability to meet minimum physical and medical requirements; and
(7) 
Possession of, or eligibility for, a valid motor vehicle operator's license issued by the Commonwealth of Pennsylvania or by any other state within the United States.
B. 
If Borough Council nominates a candidate to the Civil Service Commission for a non-competitive examination, the examination by the Civil Service Commission shall seek to determine that the nominee possesses the knowledge, skill, and ability in the following areas to the degree necessary for successful job performance:
(1) 
Police administration;
(2) 
Crime prevention, investigation and detection;
(3) 
Police Department rules and regulations;
(4) 
Geography of the Borough of Gettysburg;
(5) 
Criminal justice system as it relates to municipal police service;
(6) 
Relevant federal, state and municipal statutes; and
(7) 
Assignment, motivation and review of the work of police personnel in the Borough Police Department.
C. 
If Borough Council nominates a candidate to the Civil Service Commission for a noncompetitive examination, and if such nominee is certified by the Civil Service Commission as being qualified and is thereafter appointed, or if Borough Council appoints a qualified candidate to the office of Chief of Police without nomination to the Civil Service Commission for a noncompetitive examination, such nominee or appointee, as the case may be, shall be responsible for the overall administration and operation of the Police Department, with the following duties and responsibilities:
(1) 
To plan, organize, direct, and coordinate the activities of department personnel in enforcing laws and municipal ordinances;
(2) 
To formulate rules, procedures, and policies for efficient operation of the department;
(3) 
To evaluate applicants for positions within the department and to make recommendations to the Borough Council and the Mayor for the hiring of applicants;
(4) 
To evaluate employee work performance and recommend promotions;
(5) 
To prepare budget estimates and to control budget expenditures;
(6) 
To recommend the purchase of equipment and supplies;
(7) 
To attend county, state and national conferences and meetings, at the discretion of the Mayor and the Borough Council;
(8) 
To meet on a regular basis with the Borough Manager, Borough Council, and the Mayor, and to keep them informed on departmental activities;
(9) 
To attend all Council meetings, and any other meetings and/or activities as directed by the Borough Council and the Mayor;
(10) 
To review applications for special event permits; and
(11) 
To perform any other duties as prescribed by the Borough Council and as directed by the Mayor.

The Parking Department of the Borough of Gettysburg is empowered to exercise those functions necessary for the administration and supervision of the on-street and off-street public parking programs, systems and facilities of the Borough of Gettysburg and for the enforcement of compliance with all parking regulations related thereto as enacted, adopted and ordained by the Borough Council of the Borough of Gettysburg.

1. 
The Parking Department of the Borough of Gettysburg is authorized to exercise and carry out those functions necessary for the administration and supervision of the on-street and off-street public parking programs, systems and facilities of the Borough of Gettysburg and to implement and to enforce compliance with the parking regulations as enacted, adopted and ordained by the Borough Council of the Borough of Gettysburg. Those functions shall include, but are not limited to, the following:
A. 
To conduct research and maintain data related to on-street and off-street public parking requirements and programs of the Borough of Gettysburg;
B. 
To distribute, to issue and to process parking tickets and citations on behalf of the Borough of Gettysburg;
C. 
To implement, to administer and to enforce compliance with the parking regulations of the Borough of Gettysburg;
D. 
To collect on behalf of the Borough of Gettysburg all revenues derived from on-street and off-street public parking programs, systems and facilities and to submit those revenues to the Borough in a manner as authorized and directed by the Borough Manager in accordance with the implementation of any such policy as adopted by the Borough Manager in his or her general supervision of the Parking Department;
E. 
To acquire parking meters and the related supplies and equipment necessary to locate, relocate, install and maintain any such parking meters;
F. 
To implement, to administer and to enforce compliance with the regulations relative to the Borough's residential permit parking system and program;
G. 
To manage, to maintain and to operate, or to cause to be managed, maintained and operated, all off-street public parking lots, systems and facilities owned or leased by the Borough of Gettysburg;
H. 
To institute negotiations or make arrangements necessary for purchase or lease of property on which to provide public parking lots, systems and facilities of the Borough of Gettysburg;
I. 
To recommend to the Borough Council of the Borough of Gettysburg any changes in rates for on-street and off-street public parking and for the use of the public parking programs, systems and facilities of the Borough of Gettysburg and for the issuance of any related permits by the Borough;
J. 
To prepare and distribute to the residents of the Borough of Gettysburg and to its visitors and to the general public information about the proper and legal use of any municipal on-street and off-street public parking programs, systems and facilities and any such information about any permit parking authorized by the Borough; and
K. 
To prepare and recommend to the Borough Council of the Borough of Gettysburg for adoption from time to time any such regulations as are necessary or convenient for the administration, supervision and enforcement of an efficient unified public parking system within the Borough of Gettysburg.

The Borough Manager may delegate administrative and enforcement functions and authority to other members of the Borough's administrative staff, in connection with the administration of this Part and the Parking Department of the Borough of Gettysburg.

Consistent with the enforcement functions authorized in this Part, the parking enforcement officers of the Parking Department of the Borough of Gettysburg shall be considered law enforcement officers of the Borough of Gettysburg and shall be empowered to enforce the regulations of the Borough Council of the Borough of Gettysburg duly enacted, adopted and ordained for the purposes of regulating or prohibiting stopping, standing or parking of vehicles within the Borough of Gettysburg and to issue tickets as authorized thereby or to issue citations as authorized thereby for the purposes of instituting summary proceedings as authorized by the Pennsylvania Rules of Criminal Procedure.

The police officers of the Gettysburg Borough Police Department or of any other police department contracted to perform police and law enforcement services in the Borough of Gettysburg shall have concurrent enforcement authority of the parking regulations of the Borough of Gettysburg and the issuance of any tickets or citations for violations thereof at all times, including, but not limited to, any periods of time when there are no Parking Department parking enforcement officers on duty for the enforcement of any such parking regulations.
