The regulations in this article are adopted for the care, management and protection of the Village Park. In furtherance thereof, the Board of Trustees is authorized to adopt and, from time to time, amend rules and regulations and establish fees and charges for the use of the Village Park.
A. 
The Board of Trustees reserves the right within its discretion to modify these rules and adopt such new rules, from time to time, by local law or by resolution as it may deem advisable.
B. 
All rules and regulations, and definitions pertaining thereto, contained in this Code shall be applicable to this article.
C. 
The use of the park is limited to residents of Nassau County and such other persons as may be authorized by this article.
D. 
Every person shall conduct himself in an orderly manner and shall endeavor to cause no discomfort or inconvenience to any person or patron.
E. 
Unless otherwise determined in the rules and regulations adopted or amended from time to time by resolution of the Board of Trustees, the park will be open from dawn to dusk and closed to the public at other hours. No person shall be permitted in the park during hours when the park is closed.
F. 
No person in the park shall:
(1) 
Willfully mark, deface, disfigure, damage, displace or remove or otherwise tamper with structures or equipment, facilities or property or parts or appurtenances thereof, whether temporary or permanent.
(2) 
Remove downed timber or other wood or materials.
(3) 
Construct or erect any structure, whether temporary or permanent.
(4) 
Climb upon or attach any rope, wire or other contrivance to or tie or hitch any animal to any tree, plant or shrub.
(5) 
Damage, cut, carve, transplant or remove or pick the flowers or seeds or damage or remove the bark of any tree, plants or shrubs.
(6) 
Dig or remove any soil or sod.
(7) 
Play or practice golf.
(8) 
Smoke or possess a lighted cigarette, cigar, pipe or other smoking instrument in the park.
(9) 
Engage in disorderly or intoxicated conduct, enter or remain therein while under the influence of intoxicating liquor or nonprescribed drugs, bring any alcoholic beverage into the park or possess, consume, sell or otherwise provide any alcoholic beverages in the park.
(10) 
Sleep or protractedly lounge on the seats or benches or other areas.
(11) 
Use loud, boisterous, threatening, abusive, insulting or indecent language.
(12) 
Engage in any disorderly conduct or behavior tending to a breach of the peace.
(13) 
Throw or deposit any wastepaper, newspaper, boxes or rubbish of any kind upon park grounds.
(14) 
Gamble or participate in or abet a game of chance.
(15) 
Disturb or interfere unreasonably with any group of persons occupying any area or participating in any activity under a permit.
(16) 
Fail or refuse to produce a permit or identification when requested to do so by any Village employee who desires to inspect the same for purposes of enforcing an ordinance or a rule.
(17) 
Hold any meeting, make a speech or address, exhibit any performance or form any parade or procession in the park without a permit.
(18) 
Solicit contributions for any purpose, whether public or private, without a permit.
(19) 
Bring any container, receptacle or bottle comprised of glass or glassware.
(20) 
Hawk or peddle in the park.
(21) 
Post or distribute any card, pamphlet or circular within the park premises without prior written consent of the Board of Trustees.
(22) 
Create a noise disturbance as defined in Chapter 158 of this Code.
No association, organization or group shall make use of or attempt to make any use of the park without first filing a written application, together with payment of any charge or fee as may be fixed by resolution of the Board of Trustees and may be subject to change from time to time.[1]
A. 
The park may be used by an association, organization or group from Monday through Friday only, between the hours of 9:30 a.m. and 6:00 p.m.
B. 
The Board of Trustees shall set the fees and charges for use of any and all facilities in the park.
C. 
The applicant must accept responsibility for the conduct of the members of the group and assume liability for all injuries to persons or property arising from the act of any member of the group.
D. 
Insurance documents must be presented with the permit application. The amount of liability insurance to be carried will be fixed by resolution of the Board of Trustees and may be subject to change from time to time.
E. 
The group's activities must be restricted to the areas designated for such purpose.
F. 
Issuance of a permit does not give the group exclusive use of the park for the time period during which the permit was granted for.
