[HISTORY: Adopted by the Town of Medfield as Art. IV, Sec. 18, of the 1926 Bylaws. Amendments noted where applicable.]
No person within the limits of any public way or within any parked or moving vehicle located upon a public way or a private way open to the public shall consume alcoholic beverages, or have on his or her person an open container of alcoholic beverages. The Board of Selectmen may make this Section of the Bylaws applicable to any private way or parking area upon written request from the owner or other party in control of such private way or parking area. Fine: $200 (Medfield police officers).
Whoever shall consume any alcoholic beverages, or have on his or her person an open container of alcoholic beverages in any public building, or on any public property, including parks, cemeteries, school houses and school grounds, and public squares, shall be punished by a fine not exceeding $200.
The foregoing Section shall not apply to any activity duly licensed by the Board of Selectmen under the applicable provisions of the Massachusetts General Laws.
All alcoholic beverages being used in violation of this Bylaw shall be seized and safely held until final adjudication of the charge against the person or persons arrested or summoned before the court, at which time they shall be returned to the person entitled to lawful possession.
