The provision of police protection and law enforcement service within the Borough's corporate limits by means of an intermunicipal agreement with Penn Township will promote the public health, safety and welfare by saving taxpayer dollars while maximizing police coverage and maintaining or improving the efficiency, effectiveness and quality of police protection and law enforcement services provided to and in the Borough.

The Borough and Penn Township are permitted to enter into joint agreements for municipal services pursuant to the Intergovernmental Cooperation Act, 53 Pa.C.S.A. ยงย 2301 et seq., and specifically for police services pursuant to the Borough Code, 53 P.S. ยงย 46202(24), and the Township Code, 53 P.S. ยงย 66507.

The Borough shall enter into an agreement with Penn Township for the provision of police services by Penn Township to and in the Borough, which agreement shall be in form and substance in substantial conformance to the agreement attached hereto and titled "Intermunicipal Agreement for the Provision of Police Services" (intermunicipal agreement). The intermunicipal agreement shall set forth the terms for the provision of police services by Penn Township, and the Borough shall be bound by same.

Penn Township shall provide police patrol and investigative and administrative services in and to Duncannon of the same nature that the township provides within the township limits. The specific terms of services are as set forth in the intermunicipal agreement and include, but are not limited to, hours of coverage, compensation, vehicles and equipment, insurance, mutual cooperation, communications, complaint management, dispute resolution, indemnification and duration.

Penn Township shall provide police services in and to the Borough by means of part-time officers and its Chief of Police. The officers shall be and remain employees of Penn Township, controlled by Penn Township and for which Penn Township shall be responsible for all wages and benefits, supplies, insurance, supervision, communications and equipment. Notwithstanding, Duncannon, by this chapter approving the intermunicipal agreement and execution of the same, accepts and agrees that Penn Township's officers have full authority to provide the police services described in the intermunicipal agreement to and in Duncannon.

The execution of the intermunicipal agreement is hereby ratified and confirmed, and Borough officers, as appropriate, are authorized to execute the intermunicipal agreement and such agreements, resolutions, authorizations or other documents and take such actions and make such advertisements as may be necessary to adopt, ratify and affirm all or any portion of the intermunicipal agreement or to implement any of its provisions, and the signatures of such Borough officials shall conclusively establish that the documents they sign are the documents referred to in or authorized by this chapter.

The Duncannon Borough Police Department, established by Ordinance No. 145, shall be dissolved concurrent with the start of the provision of police services by Penn Township under the intermunicipal agreement. Ordinance No. 145, which established the Police Department, shall be repealed in its entirety, effective as of the start of the provision of police services by Penn Township under the intermunicipal agreement.
