The Village may provide a credit against the stormwater user fee charge for a particular parcel where the owner installs and maintains private drainage facilities and improvements on-site which effectively reduce surface water runoff from that parcel. Continuing credit will be subject to the owner maintaining such facilities and improvements in a fully functioning condition as determined by the Village.
Owners seeking fee credit for private on-site facilities shall file a written application with the Village Clerk on a form provided by the Village. Applications shall include all information necessary to explain the basis for the credit. Supporting information shall accompany the application. The application shall include the amount that the owner asserts is an appropriate credit.
The Village shall, by resolution, establish a stormwater credit application fee for residential and nonresidential credit applications. The fees shall reflect the cost to the Village to review and analyze the credit application and to inspect the parcel. Application fees shall be maintained with the Village Clerk.
The Village shall review a credit application within 90 days of filing. The Village shall notify the owner, in writing, of its decision within 10 days of its determination. The Village's determination of credit is final.
In no event shall credit for the stormwater user fee exceed 85% of the stormwater user fee in effect for the parcel. The remaining 15% of the user fee represents that portion of the fee necessary for administration of this chapter.
The Village shall periodically inspect all stormwater facilities and improvements for which a credit has been given to determine if such facilities and improvements are properly performing. In the event a facility or improvement is determined by the Village to not be properly performing, the Village shall issue an order to repair the facilities and improvements. If the repairs are not completed within 60 days of the date of the order, the Village may issue an order reducing or eliminating the credit. Any owner who fails to comply with a Village order within 60 days shall be ineligible to reapply for a credit for a period of two years.
