The New Jersey Uniform Fire Code, N.J.A.C. 5:70-1.1 et seq.,
shall be locally enforced within the Borough of Milford by adoption
of this article, which Uniform Fire Code is hereby incorporated, in
its entirety, by reference herein.
The local enforcing agency within the Borough of Milford shall
be the Milford Borough Department of Fire Prevention, which is hereby
created and established by this article.
The Department of Fire Prevention, the local enforcement agency,
shall enforce the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et
seq., and the Uniform Fire Code and regulations promulgated thereunder
in all buildings, structures and premises within the established boundaries
of the Borough of Milford, except owner-occupied one- and two-family
dwellings and buildings owned or operated by the federal and state
governments and interstate agencies, and shall faithfully comply with
the requirements of the Uniform Fire Safety Act and the Uniform Fire
Code.
The Department of Fire Prevention established by §
14-2 of this article shall be under the direct supervision and control of a Fire Official who shall report to a Milford Borough Council member who shall be designated by the Mayor to serve as the Fire Liaison and/or Fire Chair. The Fire Official shall coordinate all daily activities and workload with the New Jersey State Code Enforcement Office.
Pursuant to Sections 15 and 16 of the Uniform Fire Safety Act
(see N.J.S.A. 52:27D-206 and 52:27D-207), any person aggrieved by
an order of the Department of Fire Prevention shall have the right
to appeal pursuant to applicable law.
The Department of Fire Prevention established by §
14-2 of this article shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs. The permit fees, annual registration fees for life-hazard uses and application fees shall be as set forth in N.J.A.C. 5:70-2.9, as amended, from time to time to be established by the State Uniform Fire Code, which shall be incorporated by reference herein.
