In this article, the following definitions shall apply:
All equipment other than fire trucks and equipment normally
carried on fire trucks.
All substances other than water.
A.
Fire and EMS charges. The Town of Addison shall charge property owners
within the Town of Addison a fee for the cost of specialized extinguishing
agents, chemicals, water used outside the Allenton Sanitary District,
specialized equipment, neutralizers or similar materials provided
by the Allenton Volunteer Fire Department or the St. Lawrence Volunteer
Fire Company in an amount as set forth by resolution which shall be
amended from time to time.[2]

B.
Billing; delinquent charges. If the Allenton Volunteer Fire Department
or the St. Lawrence Volunteer Fire Company is unable to secure payment
after making reasonable effort to collect for the cost of specialized
extinguishing agents, chemicals, water used outside the Allenton Sanitary
District, specialized equipment, neutralizers or similar materials
within 120 days of the initial billing, the Fire Department shall
bill the Town of Addison for these expenses. The Town of Addison shall
reimburse the Fire Department for the costs of specialized extinguishing
agents, chemicals, water used outside the Allenton Sanitary District,
specialized equipment, neutralizers or similar materials within 30
days of receipt of the bill. The Town of Addison shall then have all
rights associated with the accounts receivable, and may take all measures
to collect such delinquent bills, including placing the delinquent
charges on the property owners' tax bills as a special charge.
In situations involving hazardous materials, the following provisions
shall apply:
A.
Every person, firm or corporation using, storing, handling or transporting
flammable or combustible liquids, chemicals, gases or other hazardous
materials shall comply with the requirements of Ch. SPS 310, Wis.
Adm. Code, as the same is now in force and may hereafter from time
to time be amended.
B.
Every person, firm or corporation using, storing, handling or transporting
(whether by rail or on the highways) flammable or combustible liquids,
chemicals, gases or other hazardous materials shall be liable to the
Town for the actual cost of labor and materials associated with the
use of any special extinguishing agents, chemicals, neutralizers or
similar materials or equipment employed to extinguish, confine, neutralize,
contain or clean up any such hazardous material which is involved
in any fire or accidental spill or in the threat of any fire or accidental
spill.
