To assist in reducing the financial impact of the demand for additional park and open space resulting from new dwelling units in the Town, this article establishes fees to be paid and collected in connection with the residential development of land within the Town.
A park fee as from time to time established by resolution of the Town Board[2] shall, except as provided in Subsection D hereof, be paid and collected as follows:
A. 
When lots or parcels are created after June 18, 1992, by certified survey map or subdivision plat, each lot or parcel created shall be subject to the fees, which shall be paid at the time of final approval of such maps or plats in accordance with Section 8.07 of the Town Ordinance Regulating Land Divisions and in accordance with Section 24.02(4)(g) of the Washington County Land Division Code.
B. 
When a lot or parcel created after June 18, 1992, has a zoning classification which permits more than one dwelling unit per lot or parcel, the fee for one dwelling unit shall be paid and collected when the certified survey map or subdivision plat is approved and the fees for the additional dwelling units shall be paid and collected in connection with the issuance of a building permit as provided in § 158-10 of Chapter 158, Building Construction.
C. 
When residential development occurs which does not come within the provisions of Subsection A or B above, the fees shall be collected in connection with the issuance of the building permit as provided in § 158-10 of Chapter 158, Building Construction.
D. 
The fees imposed by this section are not applicable to a lot or parcel created for an existing dwelling or for a dwelling unit constructed on a lot or parcel created by certified survey map or subdivision prior to June 19, 1992.
E. 
The park fees collected pursuant to this article shall be held, invested, and disbursed from time to time for park acquisition, development, and improvement purposes as directed by the Town Board.
