This article shall apply to those landowners, corporate or individual, who or which own land in the Township of Penn and shall, at their own expense, develop or improve their land, and land of others, which improvements shall subsequently be dedicated and transferred to the sole control and ownership of the Township of Penn.
A. 
The Board of Commissioners of Penn Township may grant permission to a landowner to construct improvements in any street upon which his property abuts or along any land which he owns or has the beneficial use thereof under the supervision and direction of the Board of Commissioners of Penn Township and in accordance with its regulations and specifications.
B. 
The landowner shall enter into an agreement with the Township, in a form approved by the Township Solicitor, to comply with the Township regulations and specifications and to construct the improvement without expense to the Township.
C. 
The contractor selected by the landowner shall file a corporate bond or other approved security with the Township in an amount fixed by the Township conditioned upon compliance with the regulations and specifications adopted by the Township or the Commonwealth of Pennsylvania.
D. 
Upon completion of the improvements, the landowner shall provide for the preparation of a plan which shall set forth the location of the improvements and pertinent engineering data which shall be kept on file with the Township.
E. 
If an improvement built without cost to the Township is located on private property, it shall be the obligation of the landowner to maintain it without expense or obligation of the Township, except that when, in the judgment of the Township, it is in the best interest of the Township, the Township may assume the obligation, provided that the landowner executes and records an agreement, satisfactory to the Township Solicitor, whereby an easement or right-of-way of sufficient width to protect and maintain the improvement is granted and the Township is given the right of entry for inspection, repair and reconstruction.[1]
