A.
Words
and phrases. Whenever any words and phrases are used in this chapter,
the meaning respectively ascribed to them in Subtitle 1 of Title 39
of the Revised Statutes of New Jersey shall be deemed to apply to
such words and phrases used herein.
B.
Official
time standard. Whenever certain hours are named in this chapter, they
shall mean either Eastern standard time or Eastern daylight saving
time as may be in current use.

A.
The
Superintendent of the Department of Public Works or, in his absence,
disability or inability to act, the Mayor and, in the event of his
absence, disability or inability to act, then the Chief of Police
of the Township, is hereby authorized to provide by regulation for
the closing of any street or portion thereof to motor vehicle traffic
on any day or days whenever he finds that such closing is necessary
for the preservation of the public safety, health, or welfare.
B.
Any regulations promulgated by the Township Committee in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C.
Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Township of Mendham are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
A.
Regulations
not exclusive. The provisions of this chapter imposing a time limit
on parking shall not relieve any person of the duty to observe other,
more restrictive provisions prohibiting or limiting the stopping or
standing or parking of vehicles as set forth in N.J.S.A. 39:4-138,
any other New Jersey Statute or as hereinafter provided.
B.
Parking
prohibited during state of emergency.

(1)
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
(2)
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any peace officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
(3)
The effectiveness of this subsection is contingent upon signs being
erected as required by law.
C.
Parking
prohibited when roads are snow covered.

(1)
Whenever snow has fallen and the accumulation is such that it covers
the street or highway, an emergency shall exist and no vehicle shall
be parked on the paved portion of any road within the boundaries of
the Township. This emergency shall exist for as long as the snow continues
to fall, and shall remain in effect after the snow has ceased until
the streets have been plowed to the extent that parking will not interfere
with the normal flow of traffic.
(2)
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession

A.
Purpose,
findings and declarations.
(1)
The Township of Mendham recognizes that a high number of vehicles,
speeders and aggressive drivers may travel our roads at any given
time. In order to better promote the public health, safety, peace
and welfare, it is necessary to establish controls and regulations
directed to the safe and expeditious movement of vehicle and pedestrian
traffic through and around construction and maintenance zones and
to provide safety for the work forces performing these operations.
(2)
The governing body of the Township of Mendham finds and declares
that problems of traffic control increases when traffic must be moved
through or around street construction, maintenance operations and
utility work, above or below the ground, which requires blocking the
street and obstructing the normal flow of vehicle or pedestrian traffic;
and that such obstructions are or can become dangerous when not properly
controlled.
B.
Scope.
The provisions of this section shall apply to any person, contractor,
utility or company that obstructs, blocks or detours the normal flow
of vehicle or pedestrian traffic within the Township of Mendham.
C.
Traffic
control standards. The Township of Mendham in the County of Morris,
State of New Jersey, does hereby adopt the current Manual on Uniform
Traffic Control Devices for Streets and Highways, hereafter known
as the "MUTCD," except as hereby supplemented and amended, as it controls
and regulates whenever construction, maintenance operations or utility
work obstructs the normal flow of vehicle or pedestrian traffic. Any
person, contractor or utility that fails to comply with the provisions
of the MUTCD while performing such work is in violation of this section.
(1)
The Township of Mendham does hereby recognize that it is important
to require traffic control personnel to have an understanding of work
zone safety in compliance with the MUTCD standards. Any person, contractor
or utility that fails to comply with the provisions of the MUTCD while
performing such work is in violation of this section. The Mendham
Township Police Department shall have the authority to order the removal
from any roadway or pedestrian walkway any contractor or utility that
fails to comply with the MUTCD standards.
D.
Preconstruction
requirements. It shall be the responsibility of any person, firm or
corporation, including any public utility as required under the public
utility agreement, N.J.A.C. 16:25-9.2, wishing to conduct work on,
under or above the roadway or any work adjacent to the roadway that
will obstruct, interfere with and/or detour vehicle or pedestrian
traffic on the roadway to contact the Traffic Safety Unit of the Police
Department, prior to the start of any such work, in order to arrange
a preconstruction meeting for the submission of plans for the safe
movement of traffic during such periods of construction of work.
(1)
The preconstruction meeting must occur three or more working days
prior to the planned construction or work. "Working days" shall be
any day the Township Clerk's office is open. These preconstruction
meetings shall be arranged with the Traffic Safety Unit of the Police
Department of the Township of Mendham.
(2)
Such plans shall require approval by the Traffic Safety Unit of the
Police Department. This requirement shall be in addition to any other
permit or other approval required by any other federal, state or municipal
law, ordinance or regulation.
(3)
The occurrence of a preconstruction meeting as described above shall
not relieve the person, firm or corporation, including a public utility,
planning construction or work upon or near a roadway within the Township
of its duty to fully comply with any other requirements, terms or
preconditions established by the Township in reference to proposed
construction or work upon or adjacent to roadways within the Township.
(4)
Any person or entity failing to submit and secure approval for its
traffic control plans prior to the start of such work shall be deemed
to be in violation of this subsection.
(5)
Public utilities conducting routine maintenance which does not obstruct
or interfere with traffic on the roadway shall be exempt from these
requirements. Any person, firm or corporation, including any public
utility, conducting emergency repair work on, under, above or adjacent
to the roadway shall be exempt from the requirements of this section,
provided that the below-listed emergency repair work subsection is
complied with.
E.
Emergency
contact information. The person, contractor or utility shall provide
at least two emergency contact telephone numbers to be called in case
of emergency problems at the construction or maintenance site prior
to the start of any work. If, for any reason, emergency contact cannot
be made, or if the emergency contact person does not respond to a
call from the Police Department to correct a hazardous condition,
the Township of Mendham may respond to correct the hazardous condition(s).
The reasonable fees for such emergency services by the Township of
Mendham shall be charged to the person, contractor or utility responsible
for the condition.
F.
Restrictions
on construction. The Police Department of the Township of Mendham
has identified a list of roads that are determined to be "heavily
traveled," based on existing patterns of traffic flow for the purposes
of this chapter. Such list may be updated from time to time by the
Traffic Safety Unit of the Police Department as conditions warrant
and shall be available for inspection and copying during normal business
hours. The heavily traveled roads shall include but not be limited
to: state highways, county roads and all roadways designated as through
streets pursuant to local ordinance.[1]
(1)
There shall be no construction, maintenance operations or utility
work on any roadway listed on the current heavily traveled roadway
list in the Township before the hour of 9:00 a.m. or after 4:00 p.m.
The Chief of Police, or his designee, may adjust this time limit to
permit work prior to 9:00 a.m. or after 4:00 p.m. If the Chief of
Police, or his designee, determines that the construction or maintenance
operations prior to 9:00 a.m. or after 4:00 p.m. would substantially
delay traffic or cause a safety or health hazard, the work shall then
be permitted only between 9:00 a.m. and 4:00 p.m. On all other streets,
hours of operation shall be from 7:00 a.m. to 7:00 p.m.
(2)
Road closures must be authorized by the Mayor or Acting Mayor as
permitted by law. Road closing and/or traffic detours shall not be
permitted unless preapproved by the Township Police Department.
(3)
Traffic-control personnel shall be posted at all construction or
maintenance sites when determined by the Township Police Department
that same is necessary to provide for the safe and expeditious movement
of traffic. Contractors providing traffic control must comply with
OSHA and MUTCD standards (MUTCD Chapter 6E).
(4)
Any person controlling, detouring or otherwise interfering with the
normal traffic patterns on any roadway within the Township of Mendham
shall comply with the current regulations for traffic control as established
under the MUTCD Manual, Department of Transportation and/or the Township
of Mendham Police. This shall include, but not be limited to, the
use of traffic warning signs, cones, vehicles with adequate emergency
lighting and the use of high-visibility garments when performing any
type of traffic diversion.
(5)
The Township of Mendham Police Department shall have the authority
to halt construction and require or effectuate the removal of equipment
and vehicles, stored material within the street right-of-way, backfilling
of open excavations and/or related work, in accordance with the Township
Engineer's requirements, in order to abate any nuisance and/or safety
hazard or for any violation of this section.
G.
Emergency
work. Emergency repair work is defined as situations that, if not
corrected immediately, may endanger public life, health and safety.
Recognized emergencies consist of water main breaks, gas leaks, down
power lines, road collapses, etc. The Chief of Police or designee
shall determine if traffic diversion is necessary due to an emergent
condition.

In the case of emergency repair work where emergency construction,
maintenance operations or utility work must be performed that will
obstruct, interfere or detour traffic on any roadway in the Township,
the person, contractor or utility performing such operations shall
immediately notify the Township of Mendham Police Department of such
emergency operation and shall disclose the nature of the emergency,
location, anticipated hours of operation and if necessary provide
an emergency traffic diversion plan for approval.
(2)
All emergency repair operations shall be performed with full regard
to safety and to keep traffic interference to an absolute minimum.
There shall be compliance with the current regulations for traffic
control as established under the MUTCD Manual, Department of Transportation
and/or the Township of Mendham Police. This shall include but not
be limited to the use of traffic warning signs, cones, vehicles with
adequate emergency lighting and the use of high-visibility garments
when performing any type of traffic diversion.
H.
Traffic
diversion preparation. It is to be expressly understood that no materials,
vehicles or equipment are to be placed in the roadway or sidewalk
until all construction signs, light devices and pavement markings
are installed and approved. Once normal traffic patterns are altered
the approved traffic control plan shall be employed.
I.
Notification
of traffic delays/detours. The Township of Mendham Police Department
shall have sole responsibility to notify immediately all affected
agencies, including but not limited to police, fire, EMS, the school
transportation office, of any work or construction upon or near a
roadway within the Township that would delay or interfere with the
providing of services. Such notification shall be made in a manner
pursuant to, and in compliance with, the Township Police Department's
policy and procedures.
J.
Violations
and penalties. Unless another penalty is provided by New Jersey statute,
every person convicted of a violation of a provision of this section
or any supplement thereto shall be subject to a fine of not less than
$250. A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

B.
Below are minimum standards for bus stop length which are based on
recommendations of the Institute of Transportation Engineers and Studies
conducted by the Bureau of Traffic Engineering and Safety programs.
These standards include minimum lengths required for bus stops in
order that buses may leave moving traffic lanes safely. Keep in mind
that buses must stop alongside the curb within six inches thereof
as provided by state law pursuant to N.J.S.A. 39:4-135. These minimums
are as follows:
(1)
Near side. Ninety feet plus the distance from the curbline to the
end of the curb return, property line or crosswalk, approximately
105 feet to 120 feet. Minimum acceptable length is 105 feet.
(2)
Far side. Eighty-five feet plus the distance from the curbline to
the end of the curb return, property line or crosswalk, approximately
105 feet to 120 feet. Minimum acceptable length is 105 feet.
(3)
Midblock. No intersection on either side of roadway minimum acceptable
length is 135 feet.
(4)
Far-side (after bus makes right turn). Minimum acceptable length
is 150 feet. An additional 45 feet of length should be provided for
each additional bus expected to stop simultaneously.

The locations described are hereby designated as taxi stands. No
vehicle other than a taxi shall be permitted to occupy these locations
during the times indicated.

Note: Minimum length of taxi stand near intersection is 25 feet.
Adding the sidewalk area of about 10 feet to the area where parking
is prohibited by state law would make the starting point approximately

In any space on public or private property appropriately marked for
vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5,
52:27D-119 et seq. or any other applicable law unless the vehicle
is authorized by law to be parked therein and a handicapped person
is either the driver or a passenger in that vehicle. State, county
or Municipal Law Enforcement Officers shall enforce the parking restrictions
on spaces appropriately marked for vehicles for the physically handicapped
on both public and private property.

No person shall move a vehicle not lawfully under his control into
any such prohibited area or away from a curb such distance as is unlawful.
D.

E.
Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Subsections C and D shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Mendham. The owner shall be responsible for the repair and restoration or replacement of same.

F.
Penalty for violations. The penalties for violations of this section
shall be $250 for the first offense and for a subsequent offense must
be a fine of at least $250 and up to 90 days community service on
such terms and such form as the court shall deem appropriate, or any
combination thereof.

A.
Regulation for the movement and the parking of traffic on municipal
property and Board of Education property. In accordance with the provisions
of N.J.S.A. 39:4-197, the following Municipal and Board of Education
property shall have the movement of traffic controlled by the type
of regulation indicated.

No person shall operate, or park a vehicle in violation of the regulations
indicated.

Pleasant Road. No person other than a Township employee shall park
a vehicle upon the Township Department of Public Works site at 40
Mount Pleasant Road (consisting of all of Lot 73 in Block 127 on the
Township Tax Map), except in a public parking area designated and
marked by signs of off-street parking.

The Township is hereby authorized to erect signs to regulate
parking and traffic movement and to erect stop signs on Block 137,
Lots 15, 16 and 17 in the locations depicted in Municipal Complex
Sign Exhibits A, B, and C and of the type indicated in Municipal Complex
Sign Exhibits D, E, and F which exhibits are made a part of this chapter.

The Township is hereby authorized to enforce the parking, and
traffic movement as set forth on the signs indicated in Municipal
Complex Sign Exhibits A through F in the same manner as all other
parking and traffic control devices in the Township.
(2)
All signs, posts, bolts, or other necessary materials shall be installed
and paid for by the applicant. Work shall be checked by the Police
Department to insure installations meet state and federal specifications,
and all signing shall conform to the current Manual on Uniform Traffic
Control Devices.
(3)
Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of this subsection shall be
liable to a penalty of not more than $100 or imprisonment for a term
not exceeding 15 days or both.
B.
Regulation for the movement and the parking of traffic on private
property open to the public and to which the public is invited (retail
business). In accordance with the provisions of N.J.S.A. 40:48-2.46,
on the following private property that is open to the public and to
which the public is invited, the movement of traffic shall be controlled
by the types of regulations indicated. No person shall operate or
park a vehicle in violation of the following regulations.

(a)
The Township is hereby authorized to erect signs to regulate
parking, traffic movement and speed and to erect stop signs on Block
100, Lot 17.02, in the locations depicted in Mosle Preserve Sign Exhibits
A and B, and of the type indicated in Mosle Preserve Sign Exhibits
C and D, which exhibits are made a part of this chapter.
(b)
The Township is hereby authorized to enforce the parking, speed,
and traffic movement as set forth on the signs indicated in Mosle
Preserve Sign Exhibits A through D in the same manner as all other
parking and traffic control devices in the Township.
C.
Regulation for the movement and the parking of traffic on all other
private property. In accordance with the provisions of N.J.S.A. 39:5A-1
the regulations of Subtitle 1 of the Title 39 are hereby made applicable
to the properties listed below.

D.

E.
Violations. For a violation of the provision of this section or any
supplement thereto for which no specific penalty is provided, the
offender shall be liable to a penalty of not more than $250 or imprisonment
for a term not exceeding 15 days, or both; except that for a violation
of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:4-123
et seq. or N.J.S.A. 39:4-140 et seq., the offender shall be liable
to a penalty of not less than $50 nor more than $200 or imprisonment
for a term not exceeding 15 days, or both.
