Unless otherwise specifically set forth herein, the following
definitions shall govern the provisions of this article:
NONMOTORIZED VEHICLE
Any wheeled vehicle designed for the carriage of the operator
thereof which is operated by other than a motor and shall include
bicycles, scooters and skateboards.
OPERATE
The direct operation of a nonmotorized vehicle, including
permitting, suffering, allowing, encouraging or causing such direct
operation.
PRIVATE PROPERTY
Any property neither owned by nor open for use by the public
or any portion thereof and to which the public is not generally invited.
QUASI-PUBLIC PROPERTY
Any property not owned by the public but which is rendered
available to the public for commercial purposes or otherwise and to
which the public is generally invited and shall specifically include
parking lots.
SIDEWALK
That portion of the public right-of-way abutting a public
street, paved or otherwise, which is generally available to the public
for pedestrian use, whether or not the same is maintained by the public
or a private person.
STREET
A highway as defined in N.J.S.A. 39:1-1, including alleyways.
The same shall include the areas between the curbs or, if no curbs,
that portion of the public right-of-way used for the passage of motor
vehicles.
No person shall operate any nonmotorized vehicle in such a manner
as to interfere with pedestrian or vehicular traffic or in a reckless,
careless, negligent or hazardous fashion or in any manner otherwise
prescribed by law.
The provisions of this article may be enforced by the New Jersey
State Police or other appropriate law enforcement agency having jurisdiction
or other person by the filing of a summons in the appropriate court
of competent jurisdiction.
