The proper Township officials are authorized to compile a list of all outstanding invoices for tax, water, sewer, refuse collection or similar services. From such list, the proper Township officials are authorized to ascertain the status of all outstanding invoices and, in particular, which of those are final and unappealable.
All Township officials who are authorized to issue permits or other approvals, such as officials involved in Uniform Construction Code activity, zoning activity and other land use activities, may deny any applicant a permit or approval if such applicant has outstanding a final and unappealable tax, water, sewer, refuse collection or similar account delinquency.
Any such permit or denial shall not apply to an applicant's delinquency on taxes, water, sewer, refuse collection or similar charges which are under appeal or are otherwise being contested through a court or through appropriate administrative process. If a Township official refuses to issue a permit under the authority of this article, the official shall indicate the street address, the municipal entity and county in which the property in question is located and the court and docket number for each parcel of property which is cited as a basis for the denial of the permit or the approval. The notice of the denial shall also state that the applicant may request a letter of compliance from the appropriate state agency, municipality or school district, demonstrating that the property in question is in compliance or that the apparent delinquency does not exist.
The authorities granted by this article are in addition to those granted with respect to the general powers of the Township under the Second Class Township Code,[1] the land use powers granted under the Pennsylvania Municipalities Planning Code[2] and the powers granted under the Uniform Construction Code.
