In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in § 903 of this Part, the Borough Secretary, in his discretion, may declare a snow and ice emergency (designated in this Part as a "snow emergency"). Information on the existence of a snow emergency may be given by the Borough of Elizabethtown through radio, newspaper or other available media, and information on the termination of the emergency may be given by use of the same media.

After any snow emergency is declared, it shall be unlawful, at any time during the continuance of the emergency, for any person:
A. 
To park a motor vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in § 903 of this Part; or
B. 
To drive any motor vehicle on any such snow emergency route unless that vehicle is equipped with all-season radial tires, snow tires, chains or other traction enhancement devices; and
C. 
The Elizabethtown Borough Police Department is hereby authorized to remove any vehicle and/or trailer which is parked along the snow emergency route designated in § 903 of this Part during a declared show emergency and to transport the same to an impound facility designated by the Borough. Towing, storage, and impound fees shall be charged to the owner of the vehicle and/or trailer impounded.

If, at any time during a period of snow emergency declared under § 901 of this Part, a person shall drive a motor vehicle upon a snow emergency route without having that vehicle equipped with all-season radial tires, snow tires, chains or other traction enhancement devices, that person shall be guilty of a violation of this Part and, upon conviction, shall be sentenced to pay a fine of not less than $50 nor more than $150, plus costs.

If, at any time during a period of snow emergency declared under § 901 of this Part, a person shall park a motor vehicle or allow a motor vehicle to remained parked anywhere upon a snow emergency route, that person shall be guilty of a violation of this Part and, upon conviction, shall be sentenced to pay a fine of not less than $50 nor more than $150, plus costs.
3. 
In any proceeding for a violation of this Part, proof that the motor vehicle described in the complaint was parked in violation of this Part, together with proof that the defendant named in the complaint was at the time of such violation the registered owner of said motor vehicle, shall constitute a presumption that the registered owner of such vehicle was the person who parked such vehicle at the point where, and for the time during which, such violation occurred.
