The purpose of this chapter is to implement the provisions of
the State Uniform Construction Code Act, N.J.S.A. 52:27D-119 et seq.,
hereinafter referred to as the "Act," and regulations for the New
Jersey Uniform Construction Code promulgated by the Commissioner of
the Department of Community Affairs pursuant to the Act and appearing
in Title 5, Chapter 23, of the New Jersey Administrative Code, hereafter
referred to as the "Regulations." References to "the Act" and "Regulations"
shall include any amendments and supplements hereafter made.
There is hereby established a Construction Board of Appeals
consisting of five members appointed by the Township Committee to
hear appeals from decisions by the enforcing agency. Members of the
Construction Board of Appeals shall meet the qualifications and serve
for the terms established by the Act and Regulations. The Construction
Board of Appeals shall perform the functions provided in the Act and
Regulations in accordance therewith.

A. Fees established. Pursuant to the provisions of the State Uniform Construction Code Act and Regulations, fees are hereby established, as provided in Chapter
160, Fees.
B. Fee schedule report. The Construction Official shall, with the advice
of the subcode officials, prepare and submit to the Township Committee
every two years a report recommending a fee schedule based on the
operating expenses of the enforcing agency and any other expenses
of the Township fairly attributable to the enforcement of the State
Uniform Construction Code Act and Regulations.
The Construction Official shall prepare and submit to the Township
Committee every two years a report evaluating the need for the delineation
of fire limits. This report shall indicate the recommendations of
the Construction Official, the Building Subcode Official and the Fire
Subcode Official regarding those areas which should be designated
as within fire limits, with the reasons therefor.
This chapter shall apply to all applications submitted to the
enforcing agency on and after January 1, 1977, and, as to such applications,
the provisions of this chapter and the Act and Regulations shall supersede
any provision of this revision which is specifically inconsistent.
Upon final adoption, a copy of this chapter shall be filed with
the Department of Community Affairs.
This chapter shall take effect on January 1, 1977.
