No person other than a contractor licensed under this chapter,
or governmental agency or public service company, shall be issued
a permit to excavate in any Town-owned right-of-way.
The permittee pursuant to this article shall notify the Police
Department and the Fire Department by calling the Police Department
24 hours prior to making any excavation that requires blocking more
than 50% of the width of the street. If the excavation or other repair
work planned shall cause the traffic in the highways of the Town to
be reduced to one-way traffic, then the permittee during working hours
shall be required to have at least one or more flagmen, as determined
by the Town Engineer, to control such traffic while one-way traffic
is in effect.
Excavations under this article shall be made in open cut, and
no tunneling will be allowed, except by special permission of the
Town Engineer and under such additional conditions as he may impose.
Trenches shall be braced and sheeted as required by federal and state
regulations or whenever, in the opinion of the Town Engineer, such
bracing and sheeting are necessary.
No permittee pursuant to this article shall make a trench cut
of over 30 inches in width without first obtaining permission from
the Town Engineer.

All excavated material pursuant to this article shall be compactly
piled and shall not interfere with public travel to any greater extent
than necessary. Suitable barricades must be provided and warning lights
kept burning between 1/2 hour before sunset and 1/2 hour before sunrise
and at any other times as may be required by federal and state regulations
or by the Town Engineer. If the location and extent of work is such
that a traffic director, in the opinion of the Town Engineer, is required,
such director shall be provided by the local traffic authority or
his designee at the expense of the permittee.
A.
All trenches in hard-surfaced or paved areas for excavations under
this article will be carefully backfilled, well compacted and then
provided with a temporary surface consisting of four inches of processed
aggregate and capped with 1 1/2 inches of bituminous mix. Acceptable
bank run gravel shall be used for all backfilling of trenches or other
excavation subjected to vehicular traffic loadings. In areas where
trenches or other excavations are not subject to vehicular traffic,
excavated material may be used as backfill, in accordance with DOT
standards.

B.
All backfill shall be thoroughly compacted by means of mechanical
hammers, vibrators or by pneumatic tampers, which equipment and method
will be approved by the Town Engineer prior to backfilling. Compaction
of trench backfill by puddling in lieu of mechanical compaction is
permissible only upon specific approval of the Town Engineer. The
trench surface will be maintained for a period of six months minimum,
12 months maximum, with a temporary patch of Connecticut Highway Class
II bituminous concrete. In the event that Class II bituminous concrete
is not available, Connecticut Highway Class V mix shall be used. The
bituminous material shall be placed and compacted to provide a smooth
surface across the trench matching the adjoining road grade and elevation.
A.
The Town will make all permanent repairs to road cuts, curbs and
sidewalks. Prior to issuance of a permit pursuant to this article,
the permittee will be required to make payment in the amount estimated
by the Town Engineer for costs of permanent repairs to road cuts and
sidewalks.
B.
A maintenance repair payment will also be required. This payment
will be made for possible maintenance required to temporary repairs
by the Town, and shall be determined annually by the Town Engineer,
based on prior year's experience.
C.
Upon completion of permanent repairs, the permittee will be either
billed or reimbursed for the difference between the estimated permanent
repair payment and the final permanent repair bill.
D.
If temporary repairs are adequately maintained by the permittee,
he will be returned the maintenance repair payment.
E.
Funds received for permanent repairs and for maintenance of temporary
repairs will be used for those purposes only.
F.
During the maintenance period, the permittee shall inspect the trench
at such regular intervals as may be necessary to maintain the trench
in satisfactory condition. The permittee shall make necessary repairs
to maintain the trench in satisfactory condition. If the permittee
fails to make such repairs, the Town may make such repairs as are
deemed necessary, and the permittee shall pay the cost of this work
within 30 days of billing. Failure on the part of the Town to give
notice that repairs are needed shall not relieve the permittee of
any of the duties set forth in this article.
A.
At the completion of the maintenance period pursuant to this article,
the Town shall replace the temporary pavement with a permanent base
and surface course. This permanent patch will consist of a two-inch-thick
Class II bituminous concrete surface over a six-inch processed aggregate
base. If the existing base and pavement are of a greater depth than
the minimum specified, the Town shall restore them to the actual depths
encountered.
B.
Prior to resurfacing, the Town will square cut the existing pavement
and base to a line six inches from the excavated area and remove temporary
surfacing and suitable base material from this area. Cut edges will
be thoroughly coated with bituminous emulsion prior to paving to provide
an adequate seal. Where the existing road surface comprises pavements
installed within five years prior to the date of the permit, the permanent
surface restoration shall be by capping the full roadway width or
by use of infrared heating, as directed by the Town Engineer, so that
no visible seam will result. Infrared heating may be used in other
locations, as directed by the Town Engineer.
C.
All placement of surfacing and base shall be as directed by the Town
Engineer with regard to material and method of construction.
D.
All improvements and ground surfaces such as lawns, sidewalks, curbs,
merestones, signs, mailboxes, unpaved crosswalks, driveways, walls,
fences, guardrails, monuments and property markers and similar structures
which are in any way disturbed by the work shall be replaced by the
permittee to as good a condition as existed when the work began. The
permittee shall supply new material to replace that which is lost
or damaged. Curbs and sidewalks rebuilt or relaid by the permittee
shall conform in all respects to the requirements and specifications
of the Town.
