No person other than a contractor licensed under this chapter
shall be issued a permit to construct, surface or resurface a driveway,
paved or otherwise, within the public rights-of-way of the Town.
After obtaining a permit pursuant to this article and before
commencing operations in the public right-of-way, a grade line shall
be obtained from the Town Engineer.

No private driveway of over 30 feet in width, exclusive of flares,
three-foot radius maximum, shall be constructed and no place or commercial
driveway of over 30 feet in width shall be constructed without prior
approval from the Town Engineer. Driveways existing prior to (date
of approval of these changes, September 12, 2016) can be reconstructed
to preexisting dimensions.
No driveway shall be authorized to be constructed within four
feet of a regularly constituted crosswalk, as determined by the Town
Engineer.
No driveway shall be authorized to be constructed within 20
feet of a street intersection.
Where, in the opinion of the Town Engineer, drainage conditions require a culvert, such culvert shall be installed under the specifications as outlined in Article
IX. Such culvert shall extend a minimum of two feet beyond each edge of the basic width of the driveway, and in no case shall it be less than 12 feet in length. The top side of the pipe shall be no closer than 12 inches from the surface of the driveway. Where driveways interfere with drainage of the street, as in the moving or removal of catch basins, permission shall be granted only when such change is made with the approval of the Town Engineer and according to plans prepared by a registered professional civil engineer at the expense of the contractor.
The removal of any large trees on Town property shall be carefully avoided, and plans shall be made to install driveways in such a manner that the removal of such a tree may be avoided. If in the opinion of the Town Engineer it is necessary to remove such a tree, he may authorize the contractor to so remove it, provided the contractor shall conform to all rules as set forth in Article
VII of this chapter.
