Pursuant to the provisions of N.J.S.A. 40:8A-1 et seq., the
Township is hereby authorized to enter into an agreement with the
County of Morris for the joint use by the Township and other municipalities
in the County of Morris of administrative services and facilities
of the Office of Purchasing Agent of the County of Morris appropriate
to the procurement of certain materials, supplies and equipment which
may be determined to be required by the Township and which the Township
may otherwise lawfully purchase for itself. The services and facilities
of the Office of County Purchasing Agent shall be provided without
cost to the Township and all bidding shall take place in accordance
with the law. Such agreement is on file in the Office of the Township
Clerk and is made a part hereof by reference and may be inspected
at any time.
The proper municipal officials, Mayor and Clerk, of the Township
are hereby authorized and empowered to execute, on behalf of the Township
such agreement with the County of Morris.

Pursuant to the authority contained in Section 11 of the Local
Public Contracts Law, N.J.S.A. 40A: 11-1(5), and other applicable
state statutes, rules and regulations, the Township of Mendham shall
participate as a member in the Morris County Cooperative Pricing Council
heretofore established for the purchase of work, materials and supplies.
The Mayor and Township Clerk are hereby authorized to execute
and attest a cooperative pricing agreement and renewals thereof between
the Township of Mendham and the designated lead agency of the Morris
County Cooperative Pricing Council and other participating contracting
units. Three copies thereof shall at all times remain on file in the
office of the Township Clerk for public inspection. Such agreements
shall not become effective without the prior approval of the Director
of the State Division of Local Government Services as provided by
law.
The lead agency of the Council or its appointed representative
shall advertise for and receive bids and shall perform other administrative
services for the Council in accordance with the provisions of the
cooperative pricing agreement, all in compliance with pertinent provisions
of the Local Public Contracts Law, N.J.S.A. 40A:11-1 and following,
and all applicable state statutes, rules and regulations.
Notwithstanding participation in the Morris County Cooperative
Pricing Council, no purchase or contract shall be made by the Township
of Mendham for a price which exceeds any other price available to
the Township or for a purchase in deviation from the specifications,
price or quality set forth by the Township.
