GENERAL REFERENCES
Vehicles and traffic — See Ch. 305.
As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
Includes a motorless vehicle having two tandem wheels, any one of which shall be 20 inches or more in diameter, having handlebars and a seat or seats and propelled by the feet acting on treadles connected with cranks or levers.
No operator of any bicycle or motorcycle, when upon any street, highway or thoroughfare in the Town of Brentwood, shall permit any other person or persons to ride upon the handlebars, the frame or any other place on such vehicle unless it is equipped with a tandem arrangement or auxiliary seat, so constructed as to safely accommodate each person carried thereon; and in such case, the upper half of the rear wheel must be so enclosed as to completely shield said wheel from all occupants or their clothing. Likewise, no person or persons shall ride in or on any vehicle not designed or intended for the use of passengers when the vehicle is in motion, except persons engaged in the necessary execution of their duties.
No person traveling on any bicycle, motorcycle, sled, scooter, toy wagon, roller skates or any toy vehicle shall cling to or attach himself or his conveyance to any moving automobile or horse-drawn vehicle on any of the streets or thoroughfares in the Town of Brentwood.
All bicycles owned by residents of the Town of Brentwood and operated within the corporate limits of the Town shall be registered and licensed. Application for such license shall be made with the Department of Police, and such license shall be affixed to the bicycles in a matter prescribed by the Chief of Police. The Department of Police is hereby authorized to issue and keep records of all license tags. No bicycle shall be licensed unless it is in good mechanical condition, has adequate braking and signaling devices and has a serial or identifying number stamped on the frame. Any bicycle which has no such serial or identifying number shall be assigned such number by the Department of Police, and such number shall be stamped permanently on the bicycle by the Department. Payment of the original license fee shall be as established by the Mayor and Council. The loss or defacement of license tags shall be reported to the Department of Police within 48 hours of the discovery of such loss or defacement, and new license tags shall be obtained at an additional cost as established by the Mayor and Council.

It shall be unlawful for any resident to operate a bicycle upon the streets or roads within the corporate limits of the Town of Brentwood, Maryland, unless such bicycle shall be registered and licensed in accordance with the provisions of the Code. No person shall operate a bicycle within the limits of a right-of-way or on a public highway in the Town of Brentwood unless such bicycle is equipped with lamps, reflectors and brakes in accordance with § 12-1207 of the Transportation Article of the Annotated Code of Maryland. A helmet shall also be worn when required by §§ 12-1207.1 and 21-1207.2 of the Transportation Article of the Annotated Code of Maryland.

It shall be unlawful to:
A. 
Remove, deface or change any identification mark or number or license tag on any bicycle.
B. 
Take or operate any bicycle without the permission of the owner.
C. 
Operate any bicycle not in good mechanical condition on a public highway.
D. 
Have more than one person riding on a bicycle at the same time, except for tandem bicycles, on a public highway.
E. 
Operate any bicycle in any manner contrary to existing regulations governing the operation of motor vehicles in the Town of Brentwood, Maryland.
F. 
Remove both hands from the handlebars at the same time or perform trick riding, on a public highway, when within 100 feet of a moving motor vehicle or within 50 feet of a pedestrian.
G. 
Fail to keep on the right-hand side and to give way to motor vehicles at all times.
H. 
Operate or park any bicycle without due regard for the safety of the operator or any other person or vehicle.
I. 
Park or place a bicycle in a right-of-way ordinarily used for foot traffic or where the same obstructs foot or vehicular traffic.
The Director of Police shall have authority to suspend the registration and remove the license tag from any bicycle operating contrary to any of the provisions of this chapter, for a period of 10 days, in addition to any other penalties hereinafter provided.
Any person violating any provision of this chapter shall, upon conviction, be subject to a fine of not more than $5.
All bicycles shall be inspected during the month of June each year by the Department of Police at specified locations as designated by the Chief of Police.
