A Shade Tree Commission is hereby created in and for Susquehanna
Township, Dauphin County, Pennsylvania. The said Commission shall
be constituted as provided by law and shall perform all the duties
and may exercise all the powers conferred by law upon township shade
tree commissions. The Shade Tree Commission shall be composed of five
members who shall be residents of the Township, shall be appointed
by the Board of Commissioners and shall serve without compensation.
At the time of initial appointment of the original five members, the
President of the Board of Commissioners shall designate which one
of the three sitting Commissioners shall be appointed for a three-year
term, and which one of the three sitting Commissioners shall be appointed
for a four-year term and which one of the three sitting Commissioners
shall be appointed for a five-year term. Initially, two new Commissioners
shall be appointed, one designated to serve a one-year term and one
designated to serve a two-year term. After the original five Commissioners
are appointed to the Shade Tree Commission, on expiration of the term
of any Shade Tree Commissioner, a successor shall be appointed by
the Board of Commissioners to serve a five-year term. Vacancies in
the office of Shade Tree Commissioners shall be filled by the Board
of Commissioners for the remaining unexpired portion of the term.

The Shade Tree Commission may assess penalties of not more than
$300 for each and every violation of any ordinance of such Commission
or of any of the provisions of Article XXX of the First Class Township
Code so far as it relates to shade trees.
