The following terms used in this Part shall have the following meanings:
ASSOCIATED EQUIPMENTAll equipment in a subscriber's home, provided and maintained by the operator, that is used to receive the basic service tier, regardless of whether such equipment is additionally used to receive other tiers of regulated programming service and/or unregulated service. Such equipment shall include, but is not limited to, (i) converter boxes; (ii) remote control units; and (iii) inside wiring.
BASIC SERVICEAt a minimum, all signals of domestic television broadcast stations provided to any subscriber (except a signal secondarily transmitted by satellite regardless of how such signal is ultimately received by the cable system), any public, educational, and governmental programming required by the franchise to be carried on the basic tier, and any additional video programming signals or service added to the basic tier by the cable operator.
CABLE OPERATOR or OPERATORAny person or group of persons (i) that provides cable service over a cable system and directly or through one or more affiliates owns a significant interest in such cable system, or (ii) who otherwise controls or is responsible for, through any arrangement, the management and operation of such a cable system.
CABLE SERVICEThe one-way transmission to subscribers of video programming or other programming service and subscriber interaction, if any, which is required for the selection or use of such video programming or other programming service.
CABLE SYSTEMA facility, consisting of a set of closed transmission paths and associated signal generation, reception, and control equipment that is designed to provide cable service which includes video programming and which is provided to multiple subscribers within a community, but such term does not include (i) a facility that serves only to retransmit the television signals of one or more television broadcast stations; (ii) a facility that serves subscribers without using any public right-of-way; (iii) a facility of a common carrier which is subject, in whole or in part, to the provisions of Title II of the Communications Act, except that such facility shall be considered a cable system [other than for purposes of Section 621(c) of the Communications Act] to the extent such facility is used in the transmission of video programming directly to subscribers unless the extent of that use is solely to provide interactive on-demand services; (iv) an open video system that complies with Section 653 of the Communications Act; or (v) any facilities of any electric utility used solely for operating its electric utility systems.
FCCThe Federal Communications Commission.
FRANCHISING AUTHORITYA governmental or public entity that has filed a Form 328 with the FCC and is certified by the FCC to regulate basic service and associated equipment rates, oversee the operations of a cable operator and its compliance with a franchise agreement.
PERSONAn individual, partnership, association, joint-stock company, trust, corporation or governmental entity.
SUBSCRIBERAny person or entity who contracts with a cable operator for, and lawfully receives, the video signals and applicable cable services distributed by the cable system.
