The Town Council for the Town of Southington is hereby establishing this article to adopt a procedure to be used by all boards and departments for the Town of Southington, excluding the Board of Education, for the purchase of professional services.
As used in this article, the following terms shall have the meanings indicated:
PROFESSIONAL SERVICES
The furnishing of judgment, expertise, designs, advice or efforts by persons other than Town officials or employees. The term shall include consulting, professional, financial, personal and technical services delivered by professionals, including architects, auditors, real estate appraisers, insurance agents, actuaries, engineers, computer programmers, and other technical specialists. Professional services shall not include legal services.

Purchases of professional services estimated to cost $50,000 or more shall be subject to the following requirements:
A. 
The Town Manager or department head requiring the services shall prepare a request for qualifications and request for proposal defining the specific service to be delivered by the professional, requiring those responding to set out their professional qualifications, experience and ability to deliver such services as well as the fee to be charged and containing such other information as may be required by the department head.
B. 
The Town Manager, department head, Town Attorney, the Town Council Chairman, or his/her designee, and the Town Council minority leader, or his/her designee, shall form a committee, which shall judge such proposals. The committee shall review and evaluate the proposals and may negotiate specific terms and prices with any person or firm who submits a proposal when it is deemed necessary.
C. 
The committee shall, after reviewing such proposals and negotiating specific terms, submit its report and recommendations to the Town Council along with copies of the proposals. The Town Council may accept the committee's recommendation, select one of the other proposals or reject all proposals. If the Town Council selects one of the other proposals or rejects all the proposals, the Council shall state its reasons on the record.
D. 
Notices for request for qualifications and request for proposals shall be published in accordance with the Southington Town Charter.
The Town Council may waive, with a vote of at least six members, the requirements of § 118-10 of this article whenever it determines that such waiver is in the best interests of the Town.
