A.
The Township has a preeminent obligation to ensure the well-being
of all of its citizens, and it is hereby declared that prompt notification
of environmental events within the Township will facilitate ready
evaluation of any potential risk to the public and further appropriate
emergency response activity and dissemination of information to the
public, furthering fulfillment of important governmental objectives.
B.
The provisions in this chapter are to be liberally construed to effectuate
the purposes of this chapter.
The following words, terms and phrases, when used in this chapter,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
An incident, occurrence or condition existing on any property
in connection with which the owner or person having control of such
property has an affirmative obligation arising under federal or state
law to take remedial action or report such incident, occurrence or
condition to the State Department of Environmental Protection or the
United States Environmental Protection Agency or any other governmental
agency or entity having jurisdiction.
An environmental event must be reported to the Township Division
of Police within 30 minutes of occurrence by the property owner or
other person otherwise having control of the property.
