BICYCLE — A device having two tandem wheels
of a diameter not less than 10 inches and propelled by human power.

No person who resides within this Borough shall ride or operate
a bicycle upon any street or public place within this Borough unless
said bicycle has been properly registered and tagged in accordance
with the following regulations:
A.
Every owner or operator of any bicycle within the Borough of Hamburg
shall make application to the Chief of Police for registration of
said bicycle.
B.
Registrations of bicycles shall be serially numbered and kept on
file by the Chief of Police. A charge in an amount as established,
from time to time, by resolution of the Borough Council shall be made
for each registration.
C.
The Chief of Police, or an officer assigned to him, upon receiving
proper registration of a bicycle, shall affix or cause to be affixed
to the frame of the bicycle an identification tag serially numbered
to correspond with the bicycle registration in such position as to
be plainly visible. A registration card shall be issued to the owner
of each properly registered bicycle.
E.
Bicycles registered under the provisions hereof shall be registered
once as long as the individual owns the bicycle. A charge in an amount
as established, from time to time, by resolution of the Borough Council
shall be made per registration. The Chief of Police shall affix a
tag, plate or other means of identification to each bicycle at the
time of such registration.
F.
Within 10 days after sale, transfer or dismantling of any registered
bicycle such information shall be reported to the Chief of Police
by the person in whose name the bicycle was registered. Such a person
may have the identification tag or plate replaced with a new tag or
plate upon registration of such bicycle.
G.
Every person engaged in the business of buying or selling new or
secondhand bicycles shall make a report within five days to the Chief
of Police of every bicycle purchased or sold by such dealer giving:

A rental agency shall not rent or offer any bicycle for rent unless
the bicycle is properly registered and tagged and unless such bicycle
is provided with the equipment required under the terms of this Part.

It shall be unlawful for any person wilfully or maliciously to remove,
destroy, mutilate or alter the identification tag or plate, frame
number of the bicycle or the registration card issued to the owner
thereof.

A bicycle shall be operated only on the roadway as near to the right
hand side as possible. Bicycles shall not be operated on the sidewalks
in the business district.
2.
The operator of a bicycle shall obey all official traffic signals,
signs and other control devices applicable to vehicles unless otherwise
directed by a police officer.
3.
The operator of a bicycle emerging from a driveway or building shall
yield the right-of-way to all pedestrians on the sidewalk and to all
vehicles on the roadway.
4.
The operator of a bicycle shall not carry any other person upon the
handlebar, frame or any part of the bicycle. This provision shall
not be construed to prohibit the use of bicycles built to be operated
by two or more persons.
5.
The operator of a bicycle shall not indulge in any abnormal or trick
riding and shall keep at least one hand on the handlebars at all times
while in use.
6.
Operators of bicycles shall not ride in any manner other than single
file except on paths or parts of roadways set aside for the exclusive
use of bicycles.
7.
The operators of bicycles shall not hitch onto vehicles upon a roadway.
8.
The operator of a bicycle shall park same upon the roadway at the
curb or upon the sidewalk in a rack to support the bicycle or against
a building except windows or glass doors thereof in such manner as
to afford the least obstruction to pedestrian or vehicular traffic.

Every bicycle operated upon any street or public place in the
Borough shall be equipped with brakes in good condition, with lights
and/or reflectors as required by State law and with a bell or other
device capable of giving a signal audible for at least 100 feet except
that no bicycle shall be equipped with nor shall any person use upon
a bicycle any siren or whistle. All mechanical parts of the bicycle
shall be in good working condition.

1.
Any person convicted of a violation of any provision of this Part
shall be upon conviction thereof, sentenced to a fine of not more
than $600 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 30 days, or, in the alternative,
to impounding of the bicycle for not more than seven days.
2.
Provided, any bicycle owned and/or operated by a nonresident of this Borough and the owner or operator thereof as well shall be subject to all provisions of this Part, except that registration of the bicycle shall not be required; provided, further, any violation of any provision of this Part which is also a violation of any specific provision in the laws of Pennsylvania or in the Borough's motor vehicle and traffic ordinance [Chapter 15], as the case may be, and not under this Part.
