Certain documents, one (1) copy of which is on file in the office
of the City Clerk of Higginsville, Missouri, being marked and designated
as the International Fuel Gas Code, 2021 Edition, including Appendix
Chapters A, B, C, and D, as published by the International Code Council,
Inc., be and is hereby adopted as the Fuel Gas Code of the City of
Higginsville, in the State of Missouri; for the control of building
and structures as herein provided; and each and all of the regulations,
provisions, penalties, conditions and terms of said International
Fuel Gas Code, 2021 Edition, on file in the office of the City Clerk
of Higginsville are hereby referred to, adopted and made a part hereof
as if fully set out in this Article.

That ordinance numbers R.O. 1954, CC 1976 and any and all ordinances
or parts of ordinances in conflict herewith are hereby repealed.

A. The code adopted by Section
510.330 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Fuel Gas Code, 2021 Edition, or where there is no corresponding Section in the code, the following Sections shall be enacted as additions to the code.
1.
Section 101.1. Insert: "City of Higginsville."
2.
Delete Section 103 in its entirety. Refer to Section 103 of
the International Building Code, 2021 Edition.
3.
Delete Section 106.1.1 in its entirety.
4.
Delete Section 106.1.2 in its entirety.
5.
Delete Section 115.4 in its entirety, and add new Section 115.4
as follows:
Section 115.4: Violation Penalties. Persons who shall be found
guilty of violating a provision of this code or failing to comply
with any of the requirements thereof, or who erect, install, alter
or repair any structure in violation of the approved construction
documents or directive of the Code Official, or of a permit or certificate
issued under the provisions of this code, shall be punishable by a
fine of not more than five hundred dollars ($500.00) or by imprisonment
not exceeding ninety (90) days, or both such fine and imprisonment.
Each day that a violation continues after due notice has been served
shall be deemed a separate offense.
6.
Change Section 109.4 to read: "Work commencing before permit
issuance. Any person who commences work on an installation before
obtaining the necessary permits shall be subject to penalties of one
hundred percent (100%) of the usual permit fee in addition to the
required permit fees."

Delete Section 113 in its entirety. Refer to Appendix B of the
International Building Code, 2021 Edition.

Delete Section 116.4 in its entirety, and add new Section 116.4
as follows:
Section 116.4: Unlawful Continuance. Any person who shall continue
any work after having been served with a stop work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, shall be liable to a fine of not less than fifty
dollars ($50.00), nor more than five hundred dollars ($500.00), or
by imprisonment not exceeding ninety (90) days, or by both such fine
and imprisonment. Each day that a violation continues after due notice
has been served shall be deemed a separate offense.

Delete Section 403.3.3 and 403.3.4 Add new Section 403.3.3,
Copper, Copper alloy, brass, aluminum, and aluminum alloy tubing shall
not be utilized to distribute fuel gas, nor shall it be utilized to
distribute any other fuel gas within a building or structure.
10.
Delete Section 403.4.3 and Section 403.4.4. Add new Section
403.4.3, Copper, Copper alloy, brass, aluminum, and aluminum alloy
tubing shall not be utilized to distribute fuel gas, nor shall it
be utilized to distribute any other fuel gas within a building or
structure.
11.
Section 406.4.1 is hereby amended to read as follows:
"Test Pressure. A low-pressure air gauge may be substituted
upon approval of the Code Official, in which case a pressure of twenty
(20) pounds shall be sustained by the piping for twenty (20) minutes."
12.
Section 406.4.2, Test Duration, is hereby deleted.
Any person violating any of the provisions of this Article or
of the Code adopted in this Article shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.
