No person, firm or corporation shall make or cause to be made any excavation in or adjoining any public or private street, highway, alley or thoroughfare or any residential property in the City of Olivette without adequately protecting the same by erecting such fencing or other barriers as the Building Official deems adequate to prevent persons, animals or vehicles from falling into said excavation.

Substantial barriers adequate to prevent persons from falling into same, including warning signs by day and red torches or their equivalent by night, shall be placed and maintained around all such excavations in such manner as to give reasonable notice and warning to any person approaching such excavation from any direction.

Upon order of the Building Official, in the event that he/she finds same to be necessary for the protection and safety of persons and property, excavations in any sidewalk or any portion of any public or private street, highway, alley or thoroughfare shall be covered at all times that work is not continuously being done on same by a suitable footbridge at least three (3) feet in width securely anchored at each end; provided further, that handrails shall be provided and maintained along such footbridge for all such excavations of more than three (3) feet in depth. Every person, firm or corporation who or which shall make or cause to be made an excavation in or adjacent to any public or private street, alley, highway or thoroughfare and who thereby impairs the means of egress or ingress to adjoining private property from said street, alley, highway or thoroughfare shall provide a suitable footbridge, with handrails as provided for above, at least three (3) feet in width between said street, alley, highway or thoroughfare and the adjoining private property, all upon order of the Building Official if he/she finds same to be necessary for the protection and safety of persons and property. Such path shall be lighted by red lights or torches from sunset to sunrise.

No waste material or excavated material other than that reserved for backfill or landscaping shall be allowed to accumulate at the site of any such excavation and shall be removed each day as it collects. Provided however, that no such excavated soil and material reserved for backfill or landscaping shall be allowed to remain on or adjoining any public or private street, highway, alley or thoroughfare without there being maintained from sunset to sunrise red lights or torches around said materials.

Any person, firm or corporation violating any of the provisions of this Article shall be deemed guilty of a misdemeanor and, upon conviction thereof, be subject to a fine not exceeding the sum of five hundred dollars ($500.00) for such offense.
