It shall be unlawful for any person, firm or corporation to install any tank of a capacity exceeding one hundred (100) gallons for the keeping or storage of gasoline or other volatile inflammable liquid or liquids for retail, wholesale, bulk, private or any other use without first procuring from the City Manager a permit authorizing the installation of the same.

The term "volatile inflammable liquid" shall mean any liquids which, when tested in the open air to a temperature below one hundred degrees Fahrenheit (100°F), will give forth inflammable vapor or gas. Any tank which is used by a retail dealer for the purpose of storing or keeping gasoline or other volatile inflammable liquid or liquids is hereby termed a retail storage tank. Any tank in which gasoline or other volatile inflammable liquid or liquids are kept or stored in quantities over thirty thousand (30,000) gallons is hereby termed a bulk storage tank. Any tank which is used by a wholesale dealer for the purpose of storing or keeping gasoline or other volatile inflammable liquid or liquids is hereby termed a wholesale storage tank. Any tank in which gasoline or other volatile liquid or liquids are kept in quantities less than thirty thousand (30,000) gallons is hereby termed a private storage tank.

No retail storage tank of a capacity in excess of one hundred (100) gallons shall be located, constructed, operated or installed within four hundred (400) feet of any school, public or private, schoolyard, playground, church, theatre, hospital or public asylum or the premises upon which the aforesaid buildings or institutions are located and which are used in connection therewith. All measurements shall be made from the nearest lot line on which the tank is located or is to be located, to the nearest lot line upon which any such building is located or to the nearest lot line of the premises upon which said building is located or which are used in connection therewith.

No wholesale storage tank or bulk storage tank shall be located, constructed, operated or installed within six hundred (600) feet of any school, public or private, schoolyard, playground, church, theatre, hospital or public asylum or the premises upon which the aforesaid buildings or institutions are located and which are used in connection therewith. All measurements shall be made from the nearest lot line on which the tank is located, or is to be located, to the nearest lot line upon which any such building is located or to the nearest lot line of the premises upon which said building is located or which are used in connection therewith.

No private storage tank shall be located, constructed, operated or installed within six hundred (600) feet of any school, public or private, schoolyard, playground, church, theatre, hospital or public asylum or the premises upon which the aforesaid buildings or institutions are located and which are used in connection therewith. All measurements shall be made from the nearest lot line on which the tank is located, or is to be located, to the nearest lot line upon which any such building is located or to the nearest lot line of the premises upon which said building is located or which are used in connection therewith, unless such storage tank shall be installed in such manner as to be approved by the Board of Fire Underwriters, in which case such private storage tank may be located within six hundred (600) feet of any such building but not within one hundred (100) feet of any such building.

No gasoline or other volatile inflammable liquid shall be pumped or otherwise removed from any retail storage tank, bulk storage tank, wholesale storage tank or private storage tank unless such gasoline or other inflammable liquid shall be pumped or otherwise removed from said tank by a device approved by the Board of Fire Underwriters.

The provisions of this Article shall not prohibit the replacement of any tank or tanks for the storage of gasoline or other volatile inflammable liquids where located on August 7, 1945, provided that this Article shall not authorize the installation of any additional tanks at any gasoline filling station, wholesale or retail, unless such additional tanks shall be installed in accordance herewith.
