The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
THEATER
Any place indoors or outdoors devoted to public amusement, wherein dramatic, operatic, vaudeville, burlesque performance, motion-picture exhibitions or other like forms of amusement are provided for public amusement or entertainment.
No person having the management or control of any theater shall produce any performance, show or exhibition therein, or suffer or permit any performance, show or exhibition to be given, without obtaining a license in accordance with the provisions of this chapter.
All persons applying for a license under this chapter shall make application in writing on forms to be obtained from the Municipal Clerk and shall furnish the information requested to determine the suitability of the premises to be used as a theater and the qualifications of the applicant.
Licenses required by this chapter shall be issued by the Municipal Clerk after first having determined the suitability of the premises to be used as a theater and the fitness of the applicant to conduct the theater and upon the payment of the fee requested.
Licenses required by this chapter shall be issued for the period of one year, commencing June 1 and expiring May 31 of the succeeding year, and upon the express condition that the license will be forfeited without a return of the license fee in case the licensee or his agents or servants shall violate any law, ordinance, resolution or condition imposed by the Township Council, and the Township Council reserves the right to suspend, revoke and annul such license whenever in its opinion the public good requires such action to the taken or for any reason enumerated in § 285-10 of the Code.
The Township Council reserves the right to censor and suppress any entertainment, exhibition, play, act or performance which it determines, in its opinion, offends public decency and morals. The Township Council shall first, through its Municipal Clerk, notify orally or in writing the person violating this section. If the person fails to comply with the directive of the Township Council, he shall then be subject to the penalty provided in Chapter 1, General Provisions, § 1-2, Violations; penalties, of the Code of the Township of Hamilton. The Township Council also reserves the right to so censor and suppress any public advertisement of any entertainment, exhibition, play, act or performance which it may determine, in its opinion, offends against public decency or morals, and it may order any entertainment, exhibition, play or act or performance to be produced in private prior to public exhibition in order to censor or suppress the entertainment, exhibition, play or act or performance.
License fees for theaters with individual seating and for outdoor drive-in theaters shall be as set forth in Chapter 215, Fees, of the Township Code.

Every license issued pursuant to this chapter shall be issued only upon the condition that the licensee complies with all health, fire, traffic and other safety laws and, at his own expense, cooperates with the issuing authority to eliminate traffic hazards and other unsafe conditions.
