The following rules and regulations shall be in force in any and all parks, playgrounds and other outdoor recreation places owned and under the control of the Borough of Hamburg through its Borough Manager; and, as used in this Part, the word "park" shall mean and apply to the crosshatched areas depicted on Exhibit A, attached hereto and made a part hereof, and as more fully described in Exhibit B, attached hereto and made a part hereof.[1] In this Part, the singular shall include the plural, the plural shall include the singular, the masculine shall include the feminine, and the word "person" shall mean any natural person, partnership, association, firm, company, trust or corporation.
A. 
All parks shall be open daily between the hours of 7:00 a.m. and 8:00 p.m. from May through September and 8:00 a.m. and 3:30 p.m. October through April, at which time all activities in the park shall cease; provided, however, that the park may remain open for the extended hours as specifically authorized by the Borough and the Park and Properties Committee. Overnight camping in any park may be authorized by permit by the Borough and the Park and Properties Committee. Said permits shall state the location of the camping spot, the number of persons permitted to camp pursuant to the permit, and the days and hours when the permit shall be in force. No person camping pursuant to any such permit shall violate any condition set forth in such permit.
B. 
The Borough may temporarily close the park for weather or other emergencies, protection or maintenance of facilities, wildlife management purposes or for other reasons of public safety.
C. 
No person shall injure, deface, destroy, remove, cut or damage any tree, plant, shrub, turf, building, structure, facility or fixture or other Borough property in any park.
D. 
No person shall remove any bench, seat or table from any park.
E. 
No person shall use profane language in any park or conduct himself in any lewd, immoral or commonly objectionable manner within the park or conduct himself so as to annoy any other person using the park for recreational purposes.
F. 
Within the limits of any park, no person shall undertake any commercial activity nor set up or maintain any booth, table or stand, mobile or otherwise, for any commercial activity unless specifically authorized by the Borough and the Park and Properties Committee, with "commercial activity" being defined as any activity where a fee is charged for a product or service, whether or not any money is exchanged at the park.
G. 
No person shall dispose of any waste or garbage in any park except in receptacles designated for such purposes. All persons using a park shall dispose of all waste and garbage left by them in such proper receptacles. No person shall discard, deposit, place or cast any garbage or waste upon the ground or in any waters of the park. Dumpsters in the park are for use only by park personnel and not for use by unauthorized persons.
H. 
No person shall boat, swim, bathe, wade or enter into any waters or waterways anywhere in the park except in those facilities especially created and designated for swimming and bathing.
I. 
No person shall set or maintain any fire in any park except in grills, stoves and fireplaces located and maintained by the Borough for cooking purposes; provided, however, that gas or charcoal grills may be brought into the park by users thereof and used only in certain picnic areas designated with appropriate signage and approved for such grill use by the Borough. The Borough Council reserves the right to establish and amend such designated areas by motion at a public meeting from time to time. Any proper grill use hereunder shall be extinguished upon leaving the site, shall not be left unattended, and hot coals shall be disposed of only in trash containers or areas designated with appropriate signage and approved for such disposal by the Borough.

J. 
No person shall bring into, consume upon or have in his possession or control any alcoholic or intoxicating beverage or controlled substances in any park, either for his own use or for the use of any other person.
K. 
Except on Park Road as permitted by state law, no person shall drive, operate or ride in or upon any automobile, truck, tractor, motorbike, motorized scooter, motorcycle, minibike, snowmobile or motorized vehicle or device of any sort, nor shall the owner of any such vehicle or device permit or allow another person to drive, operate or ride in or upon the same.
L. 
Except on Park Road as permitted by state law or as otherwise specifically designated, no person shall bring any bicycle, skateboard, skates or roller blades into any park or ride upon the same therein.
M. 
No person shall bring any animal into the park except that labeled as "Municipal Park along the Schuylkill River south end" on Exhibit A, attached hereto and made a part hereof (the "animal area"); provided, however, that seeing-eye dogs aiding an individual with restricted vision will be permitted in all areas of the park as long as they remain leashed.
N. 
All persons are required to immediately clean up any animal fecal matter in the animal area and dispose of same in a sanitary manner.
O. 
No person shall engage in any park in any kind of gambling game or activity at which money or other valuable thing may or shall be played for or staked or betted upon.
P. 
All games, athletics or sports activities for which specific facilities or areas shall have been provided in any park shall be confined to such facilities or areas. Games, athletics or sports activities for which no specific facilities or areas shall have been provided and which are not contrary to any other rule, regulation or law may be conducted or participated in within the park, provided that such conduct shall not annoy, disturb, inconvenience or endanger any other person in the park. The playing of golf or the use of golfing equipment is specifically prohibited in the park.
Q. 
No person shall injure, deface or destroy any notice, rule or regulation posted at any place within any park by authority of the Borough, the Recreation Board or any other lawful authority, nor shall any person post, place or otherwise display, attach or erect at any location within any park any notice, posters, signs, leaflets, placards, or similar type material, other than by authority of the Borough Council or Borough Manager.
R. 
Any profit-making organization using any park shall carry liability insurance approved by the Borough in an amount deemed sufficient by the Borough Council to provide adequate insurance coverage based on the type of event being held. Any such insurance policy must be submitted to the Borough for review at least 30 days prior to the event being planned and shall name the Borough as an additional insured.
S. 
No person shall use or operate any motorized and/or remote-controlled vehicles, toys or airplanes or use any jump houses, trampolines, dump tanks or metal detectors, unless specifically authorized by the Borough and the Park and Properties Committee.
T. 
No person shall undertake paragliding, parasailing, hang gliding or parachute jumping unless specifically authorized by the Borough and the Park and Properties Committee.
U. 
No person shall fail to promptly heed and obey a request or instruction of the Borough Manager, Recreation Director or other supervisory recreation personnel to cease and desist from any form or mode of conduct or activity contrary to or detrimental to the health, safety and general welfare of others or in violation of any rule or regulation.
V. 
Nothing stated in this Part or in any agreements or permits resulting therefrom shall in any way be taken to preclude or prohibit any authorized work or maintenance to or in the park by Borough employees or its authorized agents, servants, employees or contractors.
W. 
No person, group of persons or entity shall be permitted to reserve for exclusive use or rent a picnic pavilion for less than one hour per day.

X. 
No person, group of persons or entity shall erect or occupy any tent, stand or other structure except in certain areas designated with appropriate signage and approved for such use by the Borough. The Borough Council reserves the right to establish and amend such designated areas by motion at a public meeting from time to time. This prohibition shall not apply to group events and gatherings that have been preapproved or sponsored by the Borough and evidenced by a proper permit or other written permission from the Borough Manager or the Borough Council.

The Borough Council may, at its discretion, establish and/or adopt, by resolution, fees for engaging in specific activities and/or for the use of specific facilities in any park pursuant to written applications and/or agreements.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine not more than $600 plus costs and, in default of payment of said fine and costs, to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

The following rules and regulations are hereby established by the Borough Council of the Borough of Hamburg, Berks County, Pennsylvania, for any and all persons entering into the watershed area for the Borough of Hamburg:
A. 
No fishing, swimming, wading, damming, altering or placing/throwing rocks or other debris into any body of water.
B. 
No trespassing or hunting on spillway, catwalk or dambreast.
C. 
Animals are not allowed in dam or streams and shall be under the control of their owner at all times.
D. 
No vehicles of any type, licensed or unlicensed, allowed on watershed property.
E. 
No cutting or removal of trees or plant life.
F. 
No erecting tree stands, huts or blinds.
G. 
No trespassing into any enclosed area within the watershed.
H. 
No littering.
I. 
No alcoholic beverages of any type.
J. 
No overnight parking without permission of Borough Secretary.
K. 
No camping except in designated areas.
L. 
No open campfires within watershed except where designated.

Any person wishing to obtain permission for parking, camping and/or establishing campfires may obtain permission by calling the Hamburg Borough Secretary at the Hamburg Borough Office.
