This article shall be known as the personnel regulations of the City. Its purpose shall be to set forth and establish the personnel policies of the City for all its classified employees who are paid, in whole or in part, from funds which are budgeted and approved by the City Council, such purpose being in the spirit of Section 6.16 of the City Charter which inspires each group and individual in the employ of the City to the highest levels of ability in an atmosphere of mutual trust and respect which shall result in fair and equitable treatment of employees and improved administration, increased efficiency and economy of operation of the City's affairs.

For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section, unless the context clearly requires a different meaning:
CLASS; JOB CLASS
Positions in classified City employment sufficiently alike to permit use of such single descriptive job title, the same qualifications requirements, the same tests of competence and the same pay scale. Each "class" or "job class" shall be assigned a "class number."
CLASSIFIED EMPLOYEE
An employee of the City in its classified service as set forth in Section 2-7.
EXEMPT EMPLOYEE
An employee of the City in its exempt service as set forth in Section 2-6.
FULL-TIME EMPLOYEE
An employee whose regular workweek is the workweek normally scheduled for the position, on a continuing basis, including evening, night or weekend scheduling which may be required by the position.
PART-TIME EMPLOYEE
An employee who regularly works less than the workweek usually scheduled for the position.
POSITION
A collection of job tasks; a job, within a class, to which an employee is specifically assigned. Each "position" shall be designated by a "position number."
PROBATIONARY EMPLOYEE
As to a full-time employee, one who, at the effective date of the ordinance from which this article derives[1], has not held his/her position at such date for 12 continuous, consecutive months, or who, thereafter, has not completed such period of employment. It shall mean, as to a part-time employee, one who has not completed the probationary period which shall be extended to equate with that of a full time employee, but which shall not be longer than 12 months.
REGULAR EMPLOYEE
An employee who has completed his/her probationary period.
STATUS
An employee's situation with respect to being a regular employee or a probationary employee.
TEMPORARY EMPLOYEE
An employee whose employment, at the time he/she is hired, is reasonably anticipated to be for a duration of one year or less because of project or seasonal requirements or other qualifying circumstances.
UNIT OF GOVERNMENT
The major City functions including the general City services and the Holland Board of Public Works.

Each employee of the City shall be considered to be within either the classified service or the exempt service by virtue of the position he/she occupies.

The exempt service shall include the following:
(a) 
All elected officials and members of boards and commissions appointed by the Mayor and City Council.
(b) 
The City Manager, City Attorney, contract employees, Superintendent of Utilities, Assistant Superintendent of Utilities, and such other positions as may from time to time be determined by resolution of the Council.
(c) 
Consultants, counsel and contract employees rendering advisory services.
(d) 
Employees performing part-time or temporary work who may be specifically placed in the exempt service by the personnel rules.

The classified service shall include all employees of the City, including but not limited to the general City and the Holland Board of Public Works, that are not specifically placed in the exempt service by the provisions of Section 2-6.

The provisions of Sections 2-9 to 2-15 shall apply only to the classified service.

The declared personnel policies and objectives of the City shall include the following and such others as may hereafter be adopted by City Council and are based on the dual recognition of the employees' rights and responsibilities and the City Council's responsibilities for the orderly and efficient operation of City functions:
(a) 
To so organize the duties and responsibilities of the employees of the City so as to allow for assignment of personnel for the effective accomplishment of the mission of the unit of City government concerned and so that employees shall be classified according to related job duties.
(b) 
To describe, in writing, the job duties of each class, and to provide for establishment and direction of the positions therein by the appropriate unit of City government.
(c) 
To develop a compensation plan which will reflect fairly the differences in duties and responsibilities of the classes established and which will assure, to the extent practicable, similar pay treatment for similar work; which will reflect salary and wage rates which compare favorably with those in the area for comparable positions; and which provide a means of rewarding employees for continued good or outstanding service.
(d) 
To provide a group of compensation supplements (so-called "fringe benefits") such as, for illustration only, sick leave, vacation, health insurance and pension, which shall be those applicable to any position as of the effective date of the ordinance from which this article derives,[1] to review the same and make adjustments therein, if necessary, to the end that employees performing similar work and meeting other requirements that are similar shall receive similar total remuneration under the compensation plan and in the cost of the compensation supplements provided to the employee; and to make adjustments in the types of compensation supplements and in the extent of each, as may tend towards uniformity of the types of salary supplements and the extent of each, throughout the classified service of the City.

(e) 
To provide services, privileges and benefits to employees such as, for illustration only, bulletin boards, meal facilities, parking facilities and long-service awards, as may be appropriately provided to the class of the employee and his/her particular place of performing the work of his/her position.
(f) 
To establish for each position a work schedule which is as attractive as is practicable considering all the circumstances of such position.
(g) 
To establish for each position the rules such as, for illustration only, disaster, fire, conduct and safety, which reflect the standards of reasonable conduct sensibly expected of an employee in his/her position under the circumstances covered by the rule, for the good of the City and the employee group involved, and to establish procedures to be followed in connection with administering such rules.
(h) 
To provide procedures for recruiting, evaluation and hiring of personnel for the classified service, on the basis of objective considerations such as, for illustration only, prior experience, aptitude, education and physical fitness for the position involved, and of general character and integrity, and to give those hired appropriate orientation to the duties and responsibilities of the position undertaken.
(i) 
To determine the compensation, types of compensation supplements, the extent of each, the services, privileges and benefits, and the extent of each which shall be applicable to a position other than full-time.
(j) 
To conduct a program of personnel administration which shall include: the evaluation of an employee and his/her work performance (during his/her probationary period and thereafter); work-related training and advancement; and procedures for demotion, transfer, layoff or separation of an employee.
(k) 
To provide a procedure for consideration and appeal to a reasonable number of successively higher levels of authority of employee questions, problems, complaints and requests as they relate to wages, hours and working conditions of the classified employees.
(l) 
To establish and maintain such personnel forms and records as may be required or advisable in connection with the foregoing.

The personnel policies established in this article shall be carried out in accordance with an employee handbook, rules, regulations and procedures adopted by resolution of the City Council. The administration of such employee handbook, rules, regulations and procedures shall be the responsibility of those charged with the management, supervision and control of the appropriate unit of government under the applicable provision of the City Charter. To the extent that the City shall adopt an employee handbook for City employees, the employee handbook shall apply and prevail in the event of a conflict or interpretation of this article.

There shall continue to be a personnel officer of the City, who shall be appointed by the City Manager with consent of City Council and who shall hold his/her office until removed by the City Manager with approval of the Council or until his/her successor is appointed and has qualified. The personnel officer shall be chosen on the basis of his/her executive and administrative qualifications with special reference to his/her actual experience in, or his/her training or aptitude for, personnel administration. The personnel officer may have responsibilities in City administration apart from those as personnel officer. It shall be the responsibility of the personnel officer to prepare and submit for consideration of the City Council the employee handbook, rules, regulations and procedures referred to in Section 2-10; to seek concurrence of the boards, City officers and employees or employee groups prior to action by Council; and to carry out publication and distribution of such actions following Council's approval; and to assist and advise the various boards and City officers on methods of the administration thereof.

There may be a personnel manager/officer for one or more units of City government appointed by the manager of the unit of government involved with the approval of the board of such unit whose duties and responsibilities would encompass the application of City-wide personnel policies, practices and procedures to that function, the notification of the personnel officer of the City under Section 2-11 of personnel policies, practices and procedures of less than City-wide applicability but which he/she deems advisable for application to the unit he/she serves, and assisting the personnel officer as called upon by him/her to do so. Such a personnel manager may have other duties and responsibilities within the function which he/she serves in that capacity.

The personnel policies, practices and procedures applicable throughout the classified service of the City shall be public. Information relating thereto shall be distributed to each affected employee who is in the classified service.

Adoption, implementation and administration of the policies set forth in this article shall be carried out without regard to race, color, sex, political or religious application of the employees involved.

Upon approval thereof by the City Council, on its motion or upon recommendation of the City Manager, personnel officer or heads of the various units of government, the City Council may engage the services of consultants, counsel or other advisory assistance in the establishment, implementation or revision of the policies set forth in this article.
