Pursuant to the provisions of Section 5 of Act No. 279 of Public
Acts of 1909, as amended by Act No. 41 of Public Acts of 1969, being
Section 117.5 of the Compiled Laws of 1948, as further amended by
Act No. 8 of Public Acts of 1972, adding Section 5c, the City hereby
creates a Compensation Commission.[1] It is the purpose and intent of this article to provide
for the creation and workings of a Compensation Commission as stated
in Subsections (a), (b) and (c) of Section 5c enacted by Act No. 8
of Public Acts of 1972, and all questions of intent and interpretation
of this article or its validity shall be resolved to the extent possible
by reference to such section.

(a)
The Compensation Commission shall consist of seven members, all of
whom shall be registered electors of the City. Within 30 days after
November 22, 1972, the Mayor shall appoint the initial seven members
of the Compensation Commission, one member to serve for a term of
one year, one member to serve for a term of two years, one member
to serve for a term of three years, one member to serve for a term
of four years, one member to serve for a term of five years, one member
to serve for a term of six years, and one member to serve for a term
of seven years. As each member's term expires, another member shall
be appointed by the Mayor to serve for a term of seven years. All
members appointed after the initial appointment shall be appointed
prior to October 1 of the year of the appointment. Vacancies shall
be filled by an appointment by the Mayor for a term equal to the unexpired
term of the member leaving the Compensation Commission.
(b)
All appointments made by the Mayor, whether initial appointments,
appointments to fill expired terms or appointments to fill unexpired
terms, shall be subject to the confirmation by a majority of the members
elected and serving on the City Council.
(c)
No member or employee of the legislative, judicial or executive branch
of any level of any government or members of the immediate family
of such member or employee shall be eligible to be a member of the
compensation committee.

(a)
The Compensation Commission shall determine the salaries of the elected
officials of the City, and such determination shall be effective to
establish such salaries unless the City Council, by a resolution adopted
by two-thirds of the members elected to and serving on the City Council,
shall reject the determination. The determinations of the Compensation
Commission shall be filed with the City Clerk's office and shall become
effective on the thirtieth day following such filing unless rejected
by the City Council, in which case the then existing salary shall
remain the salary of the elected official.

Any expense allowance or reimbursement paid to any elected official
in addition to salary shall be for expenses actually incurred in the
course of City business and accounted for to the City.

(a)
The Compensation Commission shall meet for not more than 15 session
days in 1972 and every odd-numbered year thereafter, and all determinations
shall be made within 45 days following the first session day of any
calendar year. A majority of the members of the Compensation Commission
shall constitute a quorum for conducting the business of the Compensation
Commission, and the Compensation Commission shall take no action or
make any determination of salaries without the concurrence of a majority
of the members appointed and serving on the Compensation Commission.
(b)
The term "session days" as used herein shall mean any calendar day
on which the Compensation Commission meets and a quorum is present.
(c)
The members of the Compensation Commission shall receive no compensation
but shall be reimbursed by the City for their actual expenses incurred
in the performance of their duties.
